Dans le cas d\u2019esp\u00e8ce, la Cour de Cassation a confirm\u00e9 le prononc\u00e9 de la Cour d\u2019appel de Milan, qui avait consid\u00e9r\u00e9 comme ill\u00e9gale la mesure d\u2019expulsion et d\u00e9cid\u00e9 par cons\u00e9quent la r\u00e9int\u00e9gration du salari\u00e9, puisque l\u2019employeur n\u2019avait pas prouv\u00e9 l\u2019\u00e9pisode tant du point de vue de la mat\u00e9rialit\u00e9 des faits que de celui de l\u2019intentionnalit\u00e9 de la conduite. Et en effet, selon la reconstruction des faits de la Cour d\u2019appel, les t\u00e9moins avaient confirm\u00e9 qu\u2019une dispute entre les deux travailleurs \u00e9tait effectivement survenue, faisant toutefois des d\u00e9clarations divergentes sur la fa\u00e7on dont elle s\u2019\u00e9tait d\u00e9roul\u00e9e, de sorte qu\u2019on ne pouvait pas estimer avoir une preuve certaine de la dynamique des \u00e9v\u00e9nements. La soci\u00e9t\u00e9, en formant un pourvoi en cassation contre l\u2019arr\u00eat du fond, soutenait que (i) la Cour territorialement comp\u00e9tente avait estim\u00e9 de mani\u00e8re erron\u00e9e les preuves mat\u00e9rielles acquises et que (ii) le salari\u00e9 \u2013 les actes ayant \u00e9tabli que l\u2019altercation s\u2019est effectivement produite \u2013 aurait d\u00fb d\u00e9montrer que sa conduite constituait une r\u00e9action \u00e0 l\u2019agression de son coll\u00e8gue. La Cour de cassation a rejet\u00e9 la th\u00e8se du requ\u00e9rant. Ceci au motif que selon l\u2019avis des juges, en mati\u00e8re de licenciement pour juste cause, il incombe \u00e0 l\u2019employeur de d\u00e9montrer le fait attribu\u00e9 au salari\u00e9, en le prouvant tant dans sa mat\u00e9rialit\u00e9 que dans son \u00e9l\u00e9ment psychologique.
