Plus pr\u00e9cis\u00e9ment, le travailleur concluait \u00e0 l&rsquo;ill\u00e9gitimit\u00e9 du retrait de l&#8217;employeur de l&rsquo;accord compl\u00e9mentaire datant de 1998 et \u00e9tablissant le 14<sup>\u00e8me<\/sup>\u00a0mois, survenu unilat\u00e9ralement en 2014, pour violation du principe de l&rsquo;intangibilit\u00e9 de la r\u00e9mun\u00e9ration conform\u00e9ment \u00e0 l&rsquo;article 36 de la Constitution et \u00e0 l&rsquo;article 2103 du Code civil. Le travailleur affirmait, en substance, que le 14<sup>\u00e8me<\/sup> mois avait trouv\u00e9 sa source dans la relation de n\u00e9gociation entre les parties instaur\u00e9e au moment de l&#8217;embauche. La soci\u00e9t\u00e9 a \u00e9t\u00e9 rituellement constitu\u00e9e en d\u00e9duisant la l\u00e9gitimit\u00e9 de ses actes accomplis et en demandant, par cons\u00e9quent, le rejet du recours avec acquittement de toute demande y figurant. En adh\u00e9rant pleinement aux arguments de la soci\u00e9t\u00e9, le Juge des r\u00e9f\u00e9r\u00e9s a montr\u00e9 que le <strong>contrat collectif, sans pr\u00e9d\u00e9termination d&rsquo;une dur\u00e9e de validit\u00e9<\/strong> (comme en l&rsquo;esp\u00e8ce), <strong>ne peut pas engager les parties contractantes pour toujours<\/strong>. Et cela parce que la cause et la fonction sociale de la n\u00e9gociation collective, dont la discipline, toujours model\u00e9e sur des limites temporelles non excessivement dilat\u00e9es, doit s&rsquo;appuyer sur une r\u00e9alit\u00e9 socio-\u00e9conomique en constante \u00e9volution, risqueraient d&rsquo;\u00eatre rendues vaines. Par cons\u00e9quent, toujours selon le Tribunal, il est n\u00e9cessaire d&rsquo;\u00e9tendre \u00e0 la n\u00e9gociation la r\u00e8gle d&rsquo;application g\u00e9n\u00e9rale dans les magasins priv\u00e9s, selon laquelle le <strong>retrait unilat\u00e9ral<\/strong> repr\u00e9sente une <strong>cause d&rsquo;extinction ordinaire<\/strong> de toute relation \u00e0 dur\u00e9e ind\u00e9termin\u00e9e. Et pas seulement. Le Juge a soulign\u00e9 comment, dans le cas pr\u00e9sent, il a \u00e9t\u00e9 convenu au niveau des accords individuels avec le requ\u00e9rant que la r\u00e9mun\u00e9ration due comporterait un <strong>14<sup>\u00e8me<\/sup> mois<\/strong>, puisqu&rsquo;elle \u00e9tait appliqu\u00e9e exclusivement <strong>sur la base d&rsquo;un accord de deuxi\u00e8me niveau<\/strong>.
