En l\u2019esp\u00e8ce, une enqu\u00eate men\u00e9e par son employeur avait r\u00e9v\u00e9l\u00e9 que le salari\u00e9 \u00ab\u00a0<em>en respectant des horaires pr\u00e9cis\u00a0\u00bb<\/em> se rendait au si\u00e8ge de la soci\u00e9t\u00e9 immobili\u00e8re dont il \u00e9tait administrateur et responsable technique les jours pendant lesquels il avait pris le cong\u00e9 en question. La Cour, suivant son orientation, a tout d\u2019abord consid\u00e9r\u00e9 que les <strong>enqu\u00eates <\/strong>men\u00e9es par l\u2019employeur \u00e9taient <strong>valables<\/strong>, en ce que justifi\u00e9es par un <strong>soup\u00e7on de \u00ab\u00a0<em>perp\u00e9tration d\u2019actes illicites\u00a0\u00bb<\/em><\/strong> par le salari\u00e9 ne se rapportant pas seulement \u00e0 l\u2019inex\u00e9cution li\u00e9e \u00e0 l\u2019obligation professionnelle et effectu\u00e9s <strong>en dehors des heures de travail<\/strong>. Ensuite, la Cour a soulign\u00e9 la gravit\u00e9 objective du comportement, dans la mesure o\u00f9 le salari\u00e9 a utilis\u00e9 son cong\u00e9 (reconnu \u00ab\u00a0<em>pour raisons familiales graves et document\u00e9es\u00a0\u00bb<\/em>) \u00e0 <strong>d\u2019autres<\/strong> <strong>fins<\/strong> de surcroit <strong>interdites <\/strong>(conform\u00e9ment aux dispositions de l\u2019art. 4 de la Loi 53\/2000 \u00ab\u00a0<em>Pendant cette p\u00e9riode le salari\u00e9 conservait son emploi (<\/em>\u2026<em>) et ne peut exercer aucun type d\u2019activit\u00e9 professionnelle\u00a0\u00bb<\/em>). Sur ce point, la Cour a, de plus, cit\u00e9 son orientation selon laquelle \u00ab\u00a0<em>l<\/em>\u2019<em>utilisation du cong\u00e9 pour exercer une autre activit\u00e9 professionnelle est un abus justifiant un licenciement pour faute\u00a0\u00bb<\/em>. Il convient d\u2019ajouter que, selon la Cour, ce comportement porte atteinte \u00e0 la <strong>bonne foi <\/strong>de l\u2019employeur qui se voit injustement priv\u00e9 de la prestation professionnelle du salari\u00e9.
