Dans ce cas d\u2019esp\u00e8ce, la soci\u00e9t\u00e9 employeuse avait commenc\u00e9 &#8211; \u00e0 la suite d\u2019une d\u00e9claration du directeur technique, qui avait surpris le travailleur en train d\u2019utiliser son ordinateur pour des activit\u00e9s ludiques &#8211; une enqu\u00eate r\u00e9trospective qui a d\u00e9montr\u00e9 qu\u2019il jouait \u00ab\u00a0sur l\u2019ordinateur du bureau\u00a0\u00bb (jeu du Free Cell). Le travailleur a saisi en justice le retrait qui lui a \u00e9t\u00e9 ordonn\u00e9, estimant que l&#8217;employeur avait effectu\u00e9 des contr\u00f4les \u00e0 l&rsquo;aide d&rsquo;un mot de passe universel qui exigeait l&rsquo;accord syndical pr\u00e9alable ou, \u00e0 d\u00e9faut, l&rsquo;autorisation de l&rsquo;Inspection du Travail (article 4 de la loi n\u00b0 300\/70). Les juges de l\u00e9gitimit\u00e9, adh\u00e9rant aux conclusions de la Cour d\u2019Appel territorialement comp\u00e9tente, ont affirm\u00e9 que l\u2019application des garanties de proc\u00e9dure vis\u00e9es \u00e0 l\u2019art. 4 du Statut des Travailleurs est admise au cas o\u00f9 les contr\u00f4les \u00e0 distance aurait pour objet l\u2019accomplissement exact de l\u2019activit\u00e9 de travail, et non \u00e9galement quand ceux-ci (comme dans ce cas d\u2019esp\u00e8ce) visent \u00e0 v\u00e9rifier l\u2019exercice de comportements illicites des travailleurs pouvant porter pr\u00e9judice aux biens et \u00e0 l\u2019image de l\u2019entreprise. \u00c0 cet \u00e9gard, la Cour Supr\u00eame a mis en \u00e9vidence que l\u2019application de ces garanties proc\u00e9durales d\u00e9rivait d\u2019un \u00e9quilibre qui n\u2019est pas toujours ais\u00e9 entre les exigences de protection des int\u00e9r\u00eats et des biens de l&rsquo;entreprise, li\u00e9es \u00e0 la libert\u00e9 d&rsquo;initiative \u00e9conomique, et la protection indispensable de la dignit\u00e9 et de la vie priv\u00e9e du travailleur, avec une mise en balance qui ne peut ignorer les circonstances du cas concret. Et, dans ce cadre, comme l&rsquo;a \u00e9galement affirm\u00e9 la Cour europ\u00e9enne des droits de l&rsquo;homme, le juste \u00e9quilibre entre les int\u00e9r\u00eats oppos\u00e9s doit \u00eatre accord\u00e9 dans le respect non seulement des principes ayant un caract\u00e8re raisonnable et proportionnel mais aussi de la protection du droit du travailleur \u00e0 l\u2019\u00e9gard de sa vie priv\u00e9e moyennant une note d\u2019informations de l\u2019entreprise employeuse concernant le contr\u00f4le possible de ses communications, m\u00eame via Internet. Et c&rsquo;est sur la base de cette hypoth\u00e8se que, selon la Cour, on exclut du champ d\u2019application de la disposition l\u00e9gale le cas o\u00f9 l&#8217;employeur aurait effectu\u00e9 des contr\u00f4les visant \u00e0 d\u00e9terminer des comportements illicites et pr\u00e9judiciables \u00e0 des biens non li\u00e9s \u00e0 la relation de travail, d\u2019autant plus s\u2019il s\u2019agit de contr\u00f4les ex post.
