{"id":26972,"date":"2016-05-26T22:00:00","date_gmt":"2016-05-26T20:00:00","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/court-of-cassation-the-relationship-of-trust-releases-the-employer-from-continuous-pressing-2\/"},"modified":"2026-02-13T11:24:09","modified_gmt":"2026-02-13T10:24:09","slug":"court-of-cassation-the-relationship-of-trust-releases-the-employer-from-continuous-pressing-2","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/news\/court-of-cassation-the-relationship-of-trust-releases-the-employer-from-continuous-pressing-2\/","title":{"rendered":"Court of Cassation: the relationship of trust releases the employer from continuous pressing"},"content":{"rendered":"\n<p align=\"justify\"><span lang=\"en-GB\">By way of <\/span><span lang=\"en-GB\"><strong>judgment No. 10069\/2016 <\/strong><\/span><span lang=\"en-GB\">the Court of Cassation has stated the principle pursuant to which \u201c<\/span><span lang=\"en-GB\"><em>the employer <\/em><\/span><span lang=\"en-GB\"><em><strong>has the power<\/strong><\/em><\/span><span lang=\"en-GB\"><em>, but <\/em><\/span><span lang=\"en-GB\"><em><strong>not the obligation<\/strong><\/em><\/span><span lang=\"en-GB\"><em>,<\/em><\/span><span lang=\"en-GB\"><em><strong> to <\/strong><\/em><\/span><span lang=\"en-GB\"><em>continuously and regularly <\/em><\/span><span lang=\"en-GB\"><em><strong>control<\/strong><\/em><\/span><span lang=\"en-GB\"><em> its own employees<\/em><\/span><span lang=\"en-GB\">\u201d. In the case at issue and by reversing the decisions of the judges ruling on the merits, the Court of Cassation has held <\/span><span lang=\"en-GB\"><strong>the dismissal inflicted on a worker who had held himself\/herself liable for having requested expense reimbursements for an amount in excess <\/strong><\/span><span lang=\"en-GB\">of the amounts actually paid for carrying out certain activities <\/span><span lang=\"en-GB\"><strong>to be<\/strong><\/span> <span lang=\"en-GB\"><strong>lawful<\/strong><\/span><span lang=\"en-GB\">. According to the Court, the fact of having made false statements clearly underpins a criminal conduct on the worker&rsquo;s side, which <\/span><span lang=\"en-GB\"><strong>irremediably jeopardises the relationship of trust <\/strong><\/span><span lang=\"en-GB\">underlying the contractual bond between employer and subordinate. The Court adds that the <\/span><span lang=\"en-GB\"><em>\u201c<\/em><\/span><span lang=\"en-GB\"><em><strong>timeliness <\/strong><\/em><\/span><span lang=\"en-GB\"><em>of the formal disciplinary notice does not need to be <\/em><\/span><span lang=\"en-GB\"><em><strong>assessed <\/strong><\/em><\/span><span lang=\"en-GB\"><em>in connection with the moment in which the employer could<\/em><\/span> <span lang=\"en-GB\"><em>have become aware of the breach had the employer carried out regular controls on the work of its own employee, but <\/em><\/span><span lang=\"en-GB\"><em><strong>in connection with the moment in which <\/strong><\/em><\/span><span lang=\"en-GB\"><em>it <\/em><\/span><span lang=\"en-GB\"><em><strong>became fully aware<\/strong><\/em><\/span><span lang=\"en-GB\"><em>\u201d<\/em><\/span><span lang=\"en-GB\">.
