Dans le cas en question, un dirigeant avait fait recours aupr\u00e8s des autorit\u00e9s judiciaires car, selon ses dires, le licenciement lui ayant \u00e9t\u00e9 inflig\u00e9 par la filiale italienne d&rsquo;une multinationale am\u00e9ricaine devait \u00eatre consid\u00e9r\u00e9 ill\u00e9gitime, bien que reposant sur des motifs \u00e9conomiques. \u00c0 l&rsquo;appui de sa th\u00e8se, le dirigeant a \u00e9voqu\u00e9 les garanties re\u00e7ues de la part de la maison-m\u00e8re lors de son embauche, quant \u00e0 son reclassement au sein du groupe une fois d\u00e9chu de ses fonctions. En premi\u00e8re instance. le tribunal a accueilli favorablement la th\u00e8se du dirigeant, rejet\u00e9e par la suite par le juge\u00a0saisi en pourvoi et, enfin, par la Cassation. Cette derni\u00e8re a r\u00e9affirm\u00e9, en particulier, le principe juridique selon lequel l&rsquo;obligation de rep\u00eachage \u00ab\u00a0<strong><em>doit \u00eatre exclue <\/em><\/strong><em>vis-\u00e0-vis du dirigeant, car <strong>incompatible <\/strong>avec un tel poste de dirigeant assist\u00e9 par un <strong>r\u00e9gime de libre r\u00e9solubilit\u00e9 <\/strong>sans que puissent \u00eatre rappel\u00e9s les principes \u00e9labor\u00e9s par la jurisprudence pour l\u2019hypoth\u00e8se diff\u00e9rente du licenciement pour motif justifi\u00e9 objectif du non dirigeant\u00a0\u00bb<\/em>.
