Selon la Cour Supr\u00eame, l&rsquo;\u00e9vidence de la non-r\u00e9alisation d&rsquo;un r\u00e9sultat sp\u00e9cifique ne suffit pas, car il faut \u00e9galement d\u00e9montrer qu\u2019une violation coupable et n\u00e9gligente des obligations contractuelles a \u00e9t\u00e9 commise par le travailleur dans le cadre de ses prestations courantes. Dans le cas examin\u00e9, la Cour a donc rejet\u00e9 le recours d&rsquo;un employeur condamn\u00e9 \u00e0 r\u00e9int\u00e9grer et \u00e0 verser les salaires dus de la date du licenciement jusqu&rsquo;\u00e0 la r\u00e9int\u00e9gration. Parmi les motivations de la sentence, la Cour a pr\u00e9cis\u00e9 que la <strong>charge de la preuve incombant <\/strong>\u00e0 l\u2019employeur ne peut faire abstraction d&rsquo;une \u00e9valuation tenant compte de plusieurs facteurs : (i) un <strong>profil subjectif<\/strong>, qui repose sur l\u2019examen des <strong>objectifs fix\u00e9s <\/strong>avec le travailleur lors de son embauche et sur l&rsquo;\u00e9valuation de son comportement <strong>coupable et n\u00e9gligent <\/strong>; et (II) un <strong>profil objectif<\/strong>, en fonction duquel il faut <strong>comparer le rendement <\/strong>du salari\u00e9 avec celui <strong>moyen <\/strong>des autres travailleurs.
