La Cassation a notamment observ\u00e9 que l&rsquo;art. 3 de la loi italienne 604\/66 ne pr\u00e9voit pas que doivent \u00eatre all\u00e9gu\u00e9es, comme bien fond\u00e9 d&rsquo;un licenciement pour motif objectif justifi\u00e9, des \u00ab\u00a0<em>situations d\u00e9favorables<\/em>\u00a0\u00bb ou visant \u00e0 faire face \u00e0 des \u00ab\u00a0<em>frais importants \u00e0 caract\u00e8re exceptionnel\u00a0<\/em>\u00bb, lorsque qu\u2019il y a des raisons li\u00e9es \u00e0 la production, \u00e0 l&rsquo;organisation du travail et qui portent atteinte \u00e0 son fonctionnement. Dans ce sens, il suffit pour l\u00e9gitimer ce genre de licenciement \u00ab\u00a0<em>que les <strong>raisons<\/strong> inh\u00e9rentes \u00e0 l&rsquo;activit\u00e9 de production et \u00e0 l&rsquo;organisation du travail, parmi lesquelles <strong>il n&rsquo;est pas possible d\u2019exclure<\/strong> celles visant \u00e0 <strong>une meilleure efficacit\u00e9 de la gestion<\/strong> ou bien <strong>\u00e0 une augmentation de la rentabilit\u00e9 de l&rsquo;entreprise, d\u00e9terminent un changement r\u00e9el au niveau de la structure organisationnelle \u00e0 travers la suppression d&rsquo;un poste bien pr\u00e9cis<\/strong><\/em><strong>\u00a0<\/strong>\u00bb. Une interpr\u00e9tation qui, de fait, ne fausse pas la donn\u00e9e normative pr\u00e9vue par la loi italienne 604\/66 mais qui s\u2019y adapte parfaitement, en revanche, en appliquant ainsi pleinement la disposition de l\u2019art. 41 de la constitution qui pr\u00e9voit express\u00e9ment le droit de l&rsquo;entrepreneur de cr\u00e9er de l\u2019efficacit\u00e9, dans le cadre de l&rsquo;exercice de son activit\u00e9 d&rsquo;entreprise, de la fa\u00e7on qu\u2019il estime mieux adapt\u00e9e \u00e0 la gestion de son activit\u00e9 professionnelle.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Par sentence n\u00b0 25201 du 7 d\u00e9cembre 2016, la Cour de Cassation s\u2019est de nouveau prononc\u00e9e sur le cas du licenciement pour motif objectif justifi\u00e9.
