En l&rsquo;esp\u00e8ce, l&#8217;employeur d\u00e9cidait de <strong>fermer<\/strong> un <strong>service \u00e0 la suite de la perte d&rsquo;une commande sp\u00e9cifique<\/strong>, dans le but de <strong>conserver le niveau de profit de son entreprise<\/strong>. Ce choix, selon la Cour charg\u00e9e d&rsquo;examiner l&rsquo;affaire, ne peut \u00eatre mis en discussion. Le <strong>licenciement<\/strong> qui en a d\u00e9coul\u00e9, selon la Cour, est r\u00e9put\u00e9<strong> l\u00e9gitime<\/strong> dans la mesure o\u00f9 il porte sur des <strong>raisons inh\u00e9rentes \u00e0 l&rsquo;activit\u00e9 de production, \u00e0 l&rsquo;organisation du travail<\/strong> et <strong>\u00e0 son bon fonctionnement<\/strong>. Ainsi, apr\u00e8s avoir constat\u00e9 l\u2019<strong>effectivit\u00e9<\/strong> de cette <strong>r\u00e9organisation<\/strong> et la <strong>suppression de poste qui s&rsquo;en est suivie<\/strong>, le licenciement doit \u00eatre consid\u00e9r\u00e9 comme valable.
