En tranchant dans ce sens, les juges de l\u00e9gitimit\u00e9 ont rappel\u00e9 l\u2019orientation jurisprudentielle selon laquelle l&rsquo;exercice d\u2019une activit\u00e9 professionnelle durant un cong\u00e9 maladie constitue un <strong>illicite disciplinaire <\/strong>d\u00e8s lors (i) qu\u2019il laisse pr\u00e9sumer l&rsquo;<strong>absence de maladie <\/strong>ou bien (II) <strong>menace ou retarde la gu\u00e9rison <\/strong>et, par cons\u00e9quent, le retour au travail. En se r\u00e9f\u00e9rant pr\u00e9cis\u00e9ment au cas en question, la Cassation a pr\u00e9cis\u00e9 que le comportement de l&#8217;employ\u00e9 malade &#8211; consistant dans le fait de s&rsquo;\u00eatre rendu avec sa voiture dans les locaux commerciaux de son fils pour y effectuer des activit\u00e9s physiques, comme celles relatives au d\u00e9placement de petites charges ainsi que la manipulation d&rsquo;un rideau\u00a0de fer &#8211; n&rsquo;a pas constitu\u00e9 pour lui une violation des obligations de correction et de bonne foi auxquelles il doit se soumette afin de ne pas retarder la gu\u00e9rison et ce, parce que l&rsquo;activit\u00e9 extra professionnelle de l&#8217;employ\u00e9 malade \u00e9tait tellement modeste qu\u2019elle pouvait \u00eatre exerc\u00e9e sans porter atteinte \u00e0 l&rsquo;\u00e9tat physique et, donc, sans pouvoir repousser inutilement les d\u00e9lais de gu\u00e9rison avec, par cons\u00e9quent, l\u2019ill\u00e9gitimit\u00e9 du licenciement op\u00e9r\u00e9 \u00e0 son encontre.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>L\u2019arr\u00eat n\u00b0 21667 du 19 septembre 2017, de la Cour de Cassation a affirm\u00e9 que l\u2019exercice d&rsquo;une activit\u00e9 professionnelle pendant un cong\u00e9 maladie par un employ\u00e9 malade ne justifie pas toujours un licenciement sans pr\u00e9avis.
