En ordonnant sa r\u00e9int\u00e9gration en application de l&rsquo;art. 18, loi italienne n\u00b0 300\/70, la Cour d\u2019Appel avait estim\u00e9 qu\u2019un tel comportement \u00e9tait une forme d&rsquo;<strong>auto-protection <\/strong>aux sens de l&rsquo;art. <strong>1460 du code<\/strong> <strong>civil italien.<\/strong> La Cassation &#8211; tout en confirmant la <strong>r\u00e9duction des fonctions <\/strong>et l\u2019existence partielle des conditions d&rsquo;application de la norme de droit civil cit\u00e9e &#8211; a accueilli favorablement le recours de l\u2019employeur (succombant dans le jugement sur le fond) en se basant sur la th\u00e8se que l\u2019affectation \u00e0 des fonctions inf\u00e9rieures n&rsquo;autorise pas le travailleur \u00e0 devenir totalement <strong>d\u00e9faillant \u00e0 la prestation<\/strong> et ce, lorsque l\u2019employeur (comme dans le cas d\u2019esp\u00e8ce) remplit ses <strong>obligations primaires <\/strong>comme le paiement du salaire, la couverture de pr\u00e9voyance et d&rsquo;assurance, ainsi que la protection de la sant\u00e9 et de la s\u00e9curit\u00e9. Au fond, ce n\u2019est qu\u2019en cas de <strong>d\u00e9faillance totale de l&#8217;employeur<\/strong> qu\u2019est admis et estim\u00e9 justifi\u00e9 le refus \u00e0 priori d\u2019accomplir la prestation professionnelle.
