Dans le cas d\u2019esp\u00e8ce, les juges charg\u00e9s de l&rsquo;affaire avaient consid\u00e9r\u00e9 le licenciement comme ill\u00e9gitime car <em>\u00ab\u00a0les situations d\u00e9favorables n&rsquo;\u00e9taient pas de nature \u00e0 avoir une influence d\u00e9terminante sur l&rsquo;activit\u00e9 de production normale du secteur\u00a0\u00bb<\/em>. En revanche, les juges de la Cour de Cassation ont constat\u00e9 que, <strong>bien qu&rsquo;il ne soit pas possible de reconna\u00eetre une tendance \u00e9conomique n\u00e9gative<\/strong> dans le contexte d&rsquo;entreprise et du secteur de l&#8217;employeur, il \u00e9tait incontestable que ce dernier avait effectivement proc\u00e9d\u00e9 \u00e0 une<strong> r\u00e9organisation de l&rsquo;entreprise visant \u00e0 am\u00e9liorer la productivit\u00e9 et l&rsquo;organisation<\/strong>, et donc \u00e0 supprimer le poste de l&#8217;employ\u00e9 licenci\u00e9. \u00c0 la lumi\u00e8re de ces \u00e9l\u00e9ments de preuve, la Cour de Cassation a d\u00e9cid\u00e9 de rejeter l\u2019arr\u00eat de la Cour d&rsquo;appel avec comp\u00e9tence territoriale. En substance, dans un licenciement pour motif objectif justifi\u00e9, la tendance \u00e9conomique n\u00e9gative de l&rsquo;entreprise ne constitue pas un fondement factuel que l&#8217;employeur doit prouver, puisque l&rsquo;existence de raisons inh\u00e9rentes \u00e0 la productivit\u00e9 et \u00e0 l&rsquo;organisation de l&rsquo;entreprise suffit pour d\u00e9terminer fortuitement la suppression effective d&rsquo;un poste de travail pr\u00e9cis. Par ailleurs, d&rsquo;apr\u00e8s le raisonnement de la Cour, il ressort que ces motifs peuvent comprendre ceux visant \u00e0 une meilleure efficacit\u00e9 de gestion ou de production ou \u00e0 une augmentation de la rentabilit\u00e9 de l&rsquo;entreprise.
