En particulier, en confirmant la d\u00e9cision des juges du fond, la Cour de Cassation a constat\u00e9 en premier lieu que le comportement de la travailleuse &#8211; bien qu&rsquo;elle ne veuille pas le ramener \u00e0 l&rsquo;\u00e9l\u00e9ment volontaire de dol &#8211; peut certainement \u00eatre attribu\u00e9 \u00e0 un <strong>comportement caract\u00e9ris\u00e9 par faute grave<\/strong> et, par cons\u00e9quent, apte \u00e0 d\u00e9terminer un pr\u00e9judice du lien fiduciaire. De mani\u00e8re analogue, concernant l&rsquo;\u00e9l\u00e9ment objectif, la Cour a soulign\u00e9 que <em>\u00ab\u00a0la <strong>diffusion d&rsquo;un message diffamatoire<\/strong> \u00e0 travers l&rsquo;utilisation d&rsquo;un <strong>profil Facebook<\/strong> int\u00e8gre une hypoth\u00e8se de <strong>diffamation<\/strong> en raison de la capacit\u00e9 potentielle d&rsquo;atteindre un nombre ind\u00e9termin\u00e9 de personnes\u00a0\u00bb<\/em>, r\u00e9sultant ainsi susceptible de porter pr\u00e9judice, \u00e9galement \u00e0 cet \u00e9gard, au lien fiduciaire \u00e0 la base d&rsquo;une relation de travail normale.
