Dans ce contexte, la Cour cite quelques exemples d\u2019investigations l\u00e9gitimes, \u00e0 savoir lorsque l&#8217;employ\u00e9 (i) exerce une activit\u00e9 r\u00e9mun\u00e9r\u00e9e en faveur de tiers pendant les heures de travail ; (II) se rend coupable de manquements particuliers (vendre un produit et d\u00e9rober la somme encaiss\u00e9e) ou (III) exerce des activit\u00e9s extra professionnelles en contrevenant \u00e0 l\u2019interdiction de concurrence (source de dommages pour l\u2019employeur). En d&rsquo;autres termes, pour agir en toute l\u00e9gitimit\u00e9, l\u2019investigateur \u00ab ne peut pas d\u00e9passer les limites de l&rsquo;activit\u00e9 professionnelle \u00e0 proprement parler \u00bb, ce contr\u00f4le \u00e9tant r\u00e9serv\u00e9, en vertu de l&rsquo;art. 3 du Statut des Travailleurs, directement \u00e0 l\u2019employeur ou \u00e0 ses collaborateurs, dont les noms et les fonctions doivent \u00eatre communiqu\u00e9s au travailleur.
