La Cour de Cassation a notamment observ\u00e9 que l\u2019\u00e9volution financi\u00e8re n\u00e9gative d\u2019une entreprise constitue une condition pr\u00e9alable factuelle que l\u2019employeur doit obligatoirement prouver et que le juge doit v\u00e9rifier. Et ce, parce qu\u2019il suffit que les raisons inh\u00e9rentes \u00e0 l&rsquo;activit\u00e9 de production et \u00e0 l&rsquo;organisation du travail, parmi lesquelles il n&rsquo;est pas possible d\u2019exclure celles visant \u00e0 une meilleure efficacit\u00e9 de la gestion ou bien \u00e0 une augmentation de la rentabilit\u00e9 de l&rsquo;entreprise, d\u00e9terminent un <strong>changement r\u00e9el au niveau de la structure organisationnelle \u00e0 travers la suppression<\/strong> d&rsquo;un poste bien pr\u00e9cis. En revanche, si le licenciement a \u00e9t\u00e9 motiv\u00e9 en rappelant la n\u00e9cessit\u00e9 de faire face \u00e0 des situations \u00e9conomiques d\u00e9favorables ou bien \u00e0 d\u2019importants frais \u00e0 caract\u00e8re extraordinaire et s\u2019il est constat\u00e9 en jugement que la raison indiqu\u00e9e n\u2019existe pas, le licenciement s\u2019av\u00e8re injustifi\u00e9e pour une \u00e9valuation concr\u00e8te sur le manque de v\u00e9ridicit\u00e9 et sur la vacuit\u00e9 du motif all\u00e9gu\u00e9 par l&rsquo;entrepreneur. Cependant, dans ce cas cette situation n\u2019entra\u00eenerait pas automatiquement comme cons\u00e9quence l\u2019application de la protection r\u00e9elle de l\u2019emploi. La v\u00e9rification du crit\u00e8re \u00ab <strong>d\u2019inexistence manifeste de la cause \u00e0 l\u2019origine du licenciement<\/strong> \u00bb, mentionn\u00e9e au 7e alin\u00e9a de l\u2019article 18 du Statut des Travailleurs, concerne les deux conditions pr\u00e9alables de l\u00e9gitimit\u00e9 de la r\u00e9vocation pour motif objectif justifi\u00e9 et, donc, \u00e0 la fois les raisons inh\u00e9rentes \u00e0 l\u2019activit\u00e9 de production, l\u2019organisation du travail et son bon fonctionnement, et l\u2019impossibilit\u00e9 de r\u00e9ins\u00e9rer le travailleur ailleurs.
