{"id":27056,"date":"2019-02-27T23:00:00","date_gmt":"2019-02-27T22:00:00","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/le-refus-de-transformer-la-relation-de-temps-plein-en-temps-partiel-constitue-la-preuve-de-la-tentative-de-repechage\/"},"modified":"2026-02-16T16:28:28","modified_gmt":"2026-02-16T15:28:28","slug":"le-refus-de-transformer-la-relation-de-temps-plein-en-temps-partiel-constitue-la-preuve-de-la-tentative-de-repechage","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/giurisprudenza\/le-refus-de-transformer-la-relation-de-temps-plein-en-temps-partiel-constitue-la-preuve-de-la-tentative-de-repechage\/","title":{"rendered":"Le refus de transformer la relation de temps plein en temps partiel constitue la preuve de la tentative de \u00ab rep\u00eachage \u00bb"},"content":{"rendered":"\n<p>Par ordonnance n\u00b01499 du 21 janvier 2019, la Cour de Cassation a confirm\u00e9 le principe de droit selon lequel, en mati\u00e8re de licenciement pour motif objectif justifi\u00e9, la tentative de rep\u00eachage doit \u00eatre r\u00e9put\u00e9e avoir \u00e9t\u00e9 prouv\u00e9e par l&#8217;employeur qui, en alternative au licenciement, propose \u00e0 l&#8217;employ\u00e9 licenci\u00e9 de modifier ses horaires de travail.<\/p>\n<p><strong>Les faits<\/strong><\/p>\n<p>Une travailleuse employ\u00e9e au guichet et \u00e0 la billetterie par une soci\u00e9t\u00e9 op\u00e9rant dans le secteur des services d&rsquo;assurance et touristiques avait \u00e9t\u00e9 licenci\u00e9e pour motif objectif justifi\u00e9 en raison de la cession du service dans lequel elle \u00e9tait employ\u00e9e. En alternative au licenciement, la soci\u00e9t\u00e9 lui avait propos\u00e9 de transformer la relation de travail de temps plein en temps partiel, ce qu&rsquo;elle avait toutefois refus\u00e9.<\/p>\n<p>La travailleuse a donc saisi le Tribunal du travail territorialement comp\u00e9tent afin qu&rsquo;il d\u00e9clare ill\u00e9gitime le licenciement lui ayant \u00e9t\u00e9 intim\u00e9 avec toutes les cons\u00e9quences de la loi qui en d\u00e9couleraient. Comme fondement de sa requ\u00eate, la travailleuse a all\u00e9gu\u00e9 le fait que l&rsquo;offre de modification des horaires de travail ne pouvait constituer une tentative valable de rep\u00eachage, la soci\u00e9t\u00e9 ayant par ailleurs engag\u00e9 une nouvelle ressource \u00e0 temps plein un an apr\u00e8s le licenciement, en lui confiant notamment des t\u00e2ches qu&rsquo;elle accomplissait elle-m\u00eame auparavant.<\/p>\n<p>Le Tribunal a accueilli la demande de la travailleuse, mais sa d\u00e9cision a \u00e9t\u00e9 modifi\u00e9e par la Cour d\u2019appel d\u2019Anc\u00f4ne, saisie par la soci\u00e9t\u00e9.<\/p>\n<p>En particulier, la Cour d&rsquo;appel a d\u00e9clar\u00e9 le licenciement l\u00e9gitime en partant du principe que\u00a0:<\/p>\n<ul>\n\t<li>la soci\u00e9t\u00e9 avait compl\u00e8tement <strong>prouv\u00e9 la cession r\u00e9elle des activit\u00e9s <\/strong>de la zone guichet et billetterie dont l&#8217;employ\u00e9e \u00e9tait en charge\u00a0;<\/li>\n\t<li>la proposition de transformer la relation de travail, formul\u00e9e \u00e0 l&rsquo;intention de la travailleuse peu avant l&rsquo;avis de licenciement et rejet\u00e9e par celle-ci, <strong>constituait la preuve de la tentative de \u00ab\u00a0rep\u00eachage\u00a0\u00bb\u00a0<\/strong>;<\/li>\n\t<li><strong>aucune embauche n&rsquo;a eu lieu en remplacement de la travailleuse<\/strong>, car la nouvelle employ\u00e9e en question avait remplac\u00e9 une autre salari\u00e9e.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>La travailleuse a donc form\u00e9 un pourvoi en cassation contre la sentence de la Cour d&rsquo;appel.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>La d\u00e9cision de la Cour<\/strong><\/p>\n<p>La Cour de Cassation saisie a confirm\u00e9 la d\u00e9cision de la Cour avec comp\u00e9tence territoriale, consid\u00e9rant la proposition de transformation de la relation de travail de temps plein en temps partiel <strong>suffisante pour prouver la tentative de rep\u00eachage<\/strong> de la part de l&#8217;employeur.<\/p>\n<p>La Cour de Cassation a \u00e9galement soulign\u00e9 qu&rsquo;elle ne pouvait <strong>m\u00eame pas attribuer de valeur<\/strong> \u00e0 l&#8217;embauche d&rsquo;une nouvelle ressource, car cette embauche \u00e9tait la cons\u00e9quence de la cessation d&rsquo;une autre relation de travail, qui a pris fin \u00e0 un moment post\u00e9rieur \u00e0 la cl\u00f4ture de la relation de la travailleuse demanderesse.<\/p>\n<p><strong>Conclusions<\/strong><\/p>\n<p>En substance, il r\u00e9sulte du jugement comment\u00e9 que <strong>la tentative de rep\u00eachage doit \u00eatre r\u00e9put\u00e9e avoir \u00e9t\u00e9 prouv\u00e9e <\/strong>par l&#8217;employeur qui, en alternative au licenciement, <strong>propose \u00e0 l&#8217;employ\u00e9 licenci\u00e9 de modifier ses horaires de travail<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Par ordonnance n\u00b01499 du 21 janvier 2019, la Cour de Cassation a confirm\u00e9 le principe de droit selon lequel, en mati\u00e8re de licenciement pour motif objectif justifi\u00e9, la tentative de rep\u00eachage doit \u00eatre r\u00e9put\u00e9e avoir \u00e9t\u00e9 prouv\u00e9e par l&#8217;employeur qui, en alternative au licenciement, propose \u00e0 l&#8217;employ\u00e9 licenci\u00e9 de modifier ses horaires de travail.
