The <\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><b>new \u201cdata protection package\u201d<\/b><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"> has the objective of updating the European regulations, which date back to 1995 \u2013 that is, to a time when many of the new technologies did not even exist \u2013 and affording to the citizens, in the Internet and social networks era, a greater control on their personal information. Main <\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><b>innovations<\/b><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"> of the <\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><b>Regulation<\/b><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"> are <\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\">(i) the <\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><b>\u201c<\/b><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><i><b>right to be forgotten<\/b><\/i><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><b>\u201d<\/b><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\">, that is the right of the interested parties to delist a web page or information on the web; (ii) the \u201c<\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><i><b>right to data portability<\/b><\/i><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\">\u201d, that is, the right to obtain return of one\u2019s own data transmitted to an on line service and to transfer them to others (e.g., social networks); and (ii) the \u201c<\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><i><b>consent<\/b><\/i><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\">\u201d, which must be <\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><b>effective<\/b><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"> and <\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><b>unequivocal<\/b><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\">. On the other hand, the <\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><b>Directive <\/b><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\">provides, for the first time, for <\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><b>common rules <\/b><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\">for all member states regarding the <\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><b>processing of data <\/b><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\">by the police and judicial authorities for investigation purposes. In the next few months, the texts will be published in the EU Official Journal. The <\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><b>Regulation,<\/b><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"> which <\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><b>will enter into force<\/b><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"> 20 days from publication, <\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><b>will be directly applicable within two years<\/b><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"> to all member States, which shall have two years to transpose the provisions of the Directive. Therefore, in two years the new \u201c<\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\"><i>data protection package<\/i><\/span><\/span><\/span><span style=\"font-family: Verdana, serif;\"><span style=\"font-size: small;\"><span lang=\"en-GB\">\u201d will override the Italian Data Protection Code and the confidentiality laws in force in other EU member states.<\/span><\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 14 April 2016, the EU Parliament has approved the texts of the Regulation and Directive on personal data protection.
