{"id":27910,"date":"2018-06-25T22:00:00","date_gmt":"2018-06-25T20:00:00","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/feu-vert-pour-laccord-de-reclassement\/"},"modified":"2026-02-16T16:31:32","modified_gmt":"2026-02-16T15:31:32","slug":"feu-vert-pour-laccord-de-reclassement","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/prassi\/feu-vert-pour-laccord-de-reclassement\/","title":{"rendered":"Feu vert pour l\u2019Accord de reclassement"},"content":{"rendered":"\n<p style=\"text-align: justify;\"><strong>Le Minist\u00e8re du travail et des politiques sociales et l\u2019ANPAL<\/strong> (Agence Nationale pour les Politiques Actives du Travail) ont diffus\u00e9, le 7 juin 2018, une <strong>circulaire sign\u00e9e conjointement<\/strong> qui \u00e9tablit les <strong>crit\u00e8res<\/strong> et les <strong>modalit\u00e9s d\u2019acc\u00e8s \u00e0 l\u2019Accord de reclassement<\/strong> pour les travailleurs rentrant dans des secteurs d\u2019entreprise et des profils expos\u00e9s \u00e0 un risque de licenciement, en application de la mesure faisant l\u2019objet de l\u2019art. 24-bis de la Loi 148\/2015. Le format de \u00ab l\u2019Accord de reclassement \u00bb sera r\u00e9dig\u00e9 conform\u00e9ment au mod\u00e8le joint \u00e0 la circulaire. La circulaire souligne \u00e9galement le fait que, <strong>l\u2019employeur qui<\/strong>, en application du 6e alin\u00e9a de l\u2019art. 24-bis, <strong>embauche un travailleur<\/strong> pendant la p\u00e9riode o\u00f9 il b\u00e9n\u00e9ficie de l&rsquo;indemnit\u00e9 de reclassement, est exon\u00e9r\u00e9 de verser 50 % de la totalit\u00e9 des cotisations sociales, \u00e0 l\u2019exclusion des primes et des cotisations dues \u00e0 l\u2019INAIL, <strong>dans une limite maximale de 4 030 euros par an<\/strong>. Pour b\u00e9n\u00e9ficier de cet avantage, l\u2019entreprise ne doit pas pr\u00e9senter des structures propri\u00e9taires co\u00efncidant substantiellement avec celles de l\u2019employeur en cours. L\u2019exon\u00e9ration est reconnue pour <strong>une dur\u00e9e inf\u00e9rieure \u00e0<\/strong>: a) 1<strong>8 mois, en cas d\u2019embauche sous contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e; b) 12 mois, en cas d\u2019embauche sous contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e<\/strong> et si le contrat pr\u00e9cit\u00e9 est transform\u00e9 en contrat ind\u00e9termin\u00e9 pendant sa p\u00e9riode de validit\u00e9, le b\u00e9n\u00e9fice des contributions est prolong\u00e9 de six mois suppl\u00e9mentaires.
