Les faits examin\u00e9s par la Haute Cour \u00e9taient, en\nsynth\u00e8se, les suivants. Un liquidateur de sinistres a \u00e9t\u00e9 licenci\u00e9 par la\ncompagnie d\u2019assurances aupr\u00e8s de laquelle il accomplissait son activit\u00e9 de\ntravail \u00e0 l\u2019issue d&rsquo;une proc\u00e9dure disciplinaire \u00e0 son \u00e9gard motiv\u00e9e par une\nconduite gravement fautive. En particulier, le salari\u00e9 s\u2019\u00e9tait vu reprocher de\nne pas avoir effectu\u00e9, \u00e0 18 reprises, avant de proc\u00e9der aux r\u00e8glements\ncorrespondants, toutes les activit\u00e9s pr\u00e9alables et d&rsquo;instruction n\u00e9cessaires\npour v\u00e9rifier la survenance r\u00e9elle et la dynamique des \u00e9v\u00e8nements aff\u00e9rents \u00e0\ndes sinistres et des l\u00e9sions cons\u00e9cutives d\u00e9clar\u00e9es. Le Tribunal de Cosenza\navait rejet\u00e9 l&rsquo;opposition fond\u00e9e sur l\u2019article 1, paragraphe 51, de la loi\nitalienne n\u00b0 92\/2012, form\u00e9e par le salari\u00e9 et la compagnie d&rsquo;assurances \u00e0\nl\u2019encontre de l\u2019ordonnance prononc\u00e9e en r\u00e9f\u00e9r\u00e9. Par ladite d\u00e9cision, qui\nfaisait droit, en partie, \u00e0 la contestation du licenciement, avait \u00e9t\u00e9 d\u00e9clar\u00e9\nr\u00e9sili\u00e9 le rapport de travail. La compagnie d\u2019assurances avait ainsi \u00e9t\u00e9\ncondamn\u00e9 \u00e0 r\u00e9gler une indemnit\u00e9 \u00e9gale \u00e0 l\u2019\u00e9quivalent de 20 mensualit\u00e9s de la\nderni\u00e8re r\u00e9tribution globale de fait. La compagnie d\u2019assurances avait interjet\u00e9\nappel et le salari\u00e9 s\u2019\u00e9tait constitu\u00e9 partie \u00e0 la proc\u00e9dure en pr\u00e9sentant une\ndemande reconventionnelle. La Cour d\u2019appel avait consid\u00e9r\u00e9 non prouv\u00e9s les 18\n\u00e9pisodes contest\u00e9s, notant, par ailleurs que \u00ab&nbsp;la consid\u00e9rable charge de travail\nconfi\u00e9 au salari\u00e9 rendait (tout de m\u00eame) non exigible (aurait tout de m\u00eame\nrendu non exigible) la connaissance des anomalies qui, en r\u00e9alit\u00e9, n\u2019avaient\n\u00e9t\u00e9 (pr\u00e9tendument) remarqu\u00e9es par l\u2019employeur que suite \u00e0 une co\u00fbteuse et\napprofondie enqu\u00eate&nbsp;\u00bb. La Cour d\u2019appel territorialement comp\u00e9tente avait\nainsi fait droit \u00e0 la demande reconventionnelle du salari\u00e9, pour annuler le\nlicenciement inflig\u00e9 \u00e0 ce dernier, ordonnant : &#8211; d\u2019une part, \u00e0 la compagnie\nd\u2019assurances, de r\u00e9int\u00e9grer le salari\u00e9, la condamnant \u00e0 verser, \u00e0 compter de la\ndate du licenciement et jusqu\u2019\u00e0 celle de la r\u00e9int\u00e9gration effective, les\ncotisations sociales, outre les int\u00e9r\u00eats, et d\u2019autre part, au salari\u00e9, de\nrestituer le montant \u00e9quivalent \u00e0 8 mensualit\u00e9s de la r\u00e9tribution globale de\nfait, outre les accessoires du solde de tout compte. Mais ce n\u2019est pas tout. La\nCour d\u2019appel a rejet\u00e9 l\u2019exception en indemnisation de l&rsquo;<em>aliunde perceptum<\/em>\nou <em>percipendium<\/em> soulev\u00e9e par l\u2019employeur, soutenant que des\n\u00ab&nbsp;\u00e9l\u00e9ments sp\u00e9cifiques propres \u00e0 d\u00e9montrer un pr\u00e9judice mineur \u00e0\nindemniser&nbsp;\u00bb n\u2019avaient pas \u00e9t\u00e9 fournis. La compagnie d\u2019assurances a d\u00e9pos\u00e9\nun recours en cassation \u00e0 l\u2019encontre d&rsquo;un tel arr\u00eat, fond\u00e9 sur quatre moyens,\net le salari\u00e9, quant \u00e0 lui, s\u2019est oppos\u00e9 \u00e0 un recours. Nous n\u2019aborderons ici\nque le quatri\u00e8me moyen de cassation, par lequel la compagnie d\u2019assurances a\nd\u00e9nonc\u00e9 \u00ab&nbsp;l\u2019absence de motivation et\/ou motivation insuffisante concernant\nun fait controvers\u00e9 et d\u00e9cisif pour trancher ; la critique concerne le rejet de\nl\u2019exception <em>aliunde perceptum<\/em> et <em>percipendium<\/em> ; la partie\nrequ\u00e9rante fait grief \u00e0 la Cour d\u2019appel de ne pas avoir proc\u00e9d\u00e9 aux\nv\u00e9rifications n\u00e9cessaires \u00e0 ce propos, alors qu\u2019elle en avait\nl\u2019obligation&nbsp;\u00bb.
