{"id":27943,"date":"2020-02-28T09:52:15","date_gmt":"2020-02-28T08:52:15","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/procedure-disciplinaire-la-maladie-ne-justifie-pas-limpossibilite-dassister-a-laudience-orale-demandee\/"},"modified":"2026-02-16T16:31:42","modified_gmt":"2026-02-16T15:31:42","slug":"procedure-disciplinaire-la-maladie-ne-justifie-pas-limpossibilite-dassister-a-laudience-orale-demandee","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/case-law-fr\/procedure-disciplinaire-la-maladie-ne-justifie-pas-limpossibilite-dassister-a-laudience-orale-demandee\/","title":{"rendered":"Proc\u00e9dure disciplinaire : la maladie ne justifie pas l\u2019impossibilit\u00e9 d\u2019assister \u00e0 l\u2019audience orale demand\u00e9e"},"content":{"rendered":"\n<p>La Cour de Cassation, par sa sentence n\u00b0 980 du 17\njanvier 2020, a pr\u00e9cis\u00e9 que, dans le cadre d\u2019une proc\u00e9dure disciplinaire,\nl\u2019\u00e9tat de maladie ne peut pas \u00eatre suffisant en soi pour justifier de\nl\u2019impossibilit\u00e9 \u00e0 assister \u00e0 l\u2019audience demand\u00e9e pour pr\u00e9senter oralement ses\npropres contre-arguments face aux faits reproch\u00e9s.<\/p>\n\n\n\n<p><strong>Les faits de l\u2019affaire<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Le cas d\u2019esp\u00e8ce trouve son origine dans le licenciement\npour justes motifs d\u2019un salari\u00e9 de Poste Italiane S.p.a. pour abus de sa propre\nposition hi\u00e9rarchique ayant induit certains coll\u00e8gues \u00e0 activer des cartes\npr\u00e9pay\u00e9es Postpay en violation de certaines proc\u00e9dures internes. <\/p>\n\n\n\n<p>Le salari\u00e9, au cours de la proc\u00e9dure disciplinaire ayant\nculmin\u00e9 par la proc\u00e9dure d\u2019expulsion, avait demand\u00e9 dans les d\u00e9lais de d\u00e9fense\n\u00e0 \u00eatre entendu oralement concernant les faits graves qui lui \u00e9taient reproch\u00e9s.\nToutefois, celui-ci, apr\u00e8s avoir \u00e9t\u00e9 convoqu\u00e9, avait demand\u00e9 \u00e0 deux reprises le\nreport du rendez-vous sur la base de certificats m\u00e9dicaux joints. <strong><\/strong><\/p>\n\n\n\n<p>Dans les jugements d\u2019opposition et de r\u00e9clamation de la\nproc\u00e9dure Fornero, aussi bien le Tribunal que la Cour d\u2019appel de Bologne ont\nconfirm\u00e9 la l\u00e9gitimit\u00e9 du licenciement. Ceci en raison du fait que la soci\u00e9t\u00e9\nemployeur avait fix\u00e9 une date pour l\u2019audience demand\u00e9e par le salari\u00e9, la\nrenouvelant suite \u00e0 l\u2019absence de pr\u00e9sentation \u00e0 la premi\u00e8re des deux, pour\ncause de maladie. La soci\u00e9t\u00e9 avait \u00e9galement averti au pr\u00e9alable le salari\u00e9 de\nson besoin de clore la proc\u00e9dure disciplinaire avec la deuxi\u00e8me date, par\nrapport aux dispositions du contrat collectif. Comme si cela ne suffisait pas,\nle salari\u00e9 avait \u00e9t\u00e9 invit\u00e9 \u00e0 pr\u00e9senter d\u2019autres justifications \u00e9crites qu\u2019il\navait toutefois omises. <\/p>\n\n\n\n<p>Oppos\u00e9 \u00e0 la d\u00e9cision de m\u00e9rite, le salari\u00e9 a d\u00e9pos\u00e9 un\nrecours aupr\u00e8s de la Cour de Cassation, en affirmant que son droit de d\u00e9fense\nen phase disciplinaire avait \u00e9t\u00e9 l\u00e9s\u00e9, puisque la soci\u00e9t\u00e9 ne lui avait pas\naccord\u00e9 le second report de l\u2019audience orale, qu\u2019il avait demand\u00e9 pour maladie.<\/p>\n\n\n\n<p><strong>La d\u00e9cision de la Cour de\nCassation<\/strong><strong><\/strong><\/p>\n\n\n\n<p>La Cour de Cassation, en rejetant le recours du\ntravailleur, a consid\u00e9r\u00e9 les actes de la soci\u00e9t\u00e9 employeur comme correspondant\naux principes g\u00e9n\u00e9raux de correction et bonne foi contractuelle. En effet,\ncelle-ci avait d\u2019abord permis de diff\u00e9rer la premi\u00e8re rencontre puis, par la\nsuite, avait pr\u00e9alablement averti le travailleur du fait qu\u2019elle ne pouvait\naccorder une troisi\u00e8me date. Mais pas seulement. La Soci\u00e9t\u00e9 avait \u00e9galement\ninvit\u00e9 le travailleur \u00e0 pr\u00e9senter par \u00e9crit ses contre-arguments, afin de ne\npas risquer l\u2019expiration du d\u00e9lai pour la r\u00e9siliation, conform\u00e9ment aux\ndispositions du contrat collectif du secteur.<\/p>\n\n\n\n<p>Selon la Cassation, m\u00eame s\u2019il est vrai que le\ntravailleur, dans le cadre de la proc\u00e9dure disciplinaire, a le droit d\u2019\u00eatre\nentendu oralement par l\u2019employeur, celui-ci n\u2019a cependant pas droit au report\nde l\u2019audience sur la base de son \u00e9ventuel \u00e9tat de maladie, parce que cela\nn\u2019implique pas en soi l\u2019impossibilit\u00e9 absolue de s\u2019\u00e9loigner de son domicile.\nSelon l\u2019avis de la Cour, il faudrait plut\u00f4t l\u2019affirmation et la preuve que\nl\u2019\u00e9tat de maladie emp\u00eache l\u2019\u00e9loignement physique du domicile pour que soit\nint\u00e9gr\u00e9e l\u2019exigence d\u00e9fensive <em>\u00ab&nbsp;ne\npouvant \u00eatre autrement prot\u00e9g\u00e9e&nbsp;\u00bb. <\/em><\/p>\n\n\n\n<p>La Cassation sp\u00e9cifie en effet que <strong><em>\u00ab&nbsp;la simple all\u00e9gation,<\/em><\/strong><em> de la part du travailleur, m\u00eame si\ncertifi\u00e9e, de la condition de maladie <strong>ne\npeut \u00eatre une raison en soi suffisante pour justifier son impossibilit\u00e9 \u00e0\nassister \u00e0 l\u2019audience personnelle demand\u00e9e, il faut qu\u2019en soit d\u00e9duit le\ncaract\u00e8re d\u2019emp\u00eachement<\/strong> \u00e0 l\u2019\u00e9loignement physique du domicile (ou du lieu de\nsoin), afin que<strong> le report<\/strong> \u00e0 une\nnouvelle date de l\u2019audience personnelle <strong>constitue\nune exigence d\u00e9fensive effective<\/strong> ne pouvant \u00eatre autrement prot\u00e9g\u00e9e&nbsp;\u00bb.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de Cassation, par sa sentence n\u00b0 980 du 17 janvier 2020, a pr\u00e9cis\u00e9 que, dans le cadre d\u2019une proc\u00e9dure disciplinaire, l\u2019\u00e9tat de maladie ne peut pas \u00eatre suffisant en soi pour justifier de l\u2019impossibilit\u00e9 \u00e0 assister \u00e0 l\u2019audience demand\u00e9e pour pr\u00e9senter oralement ses propres contre-arguments face aux faits reproch\u00e9s.
