Exprimant un principe g\u00e9n\u00e9ral, la Cour a d\u2019abord mis en \u00e9vidence que \u00ab&nbsp;la protection r\u00e9elle du poste de travail ne peut \u00eatre pouss\u00e9e jusqu\u2019\u00e0 exclure l\u2019incidence possible d\u2019\u00e9v\u00e9nements post\u00e9rieurs d\u00e9terminant l\u2019extinction du lien d\u2019obligation&nbsp;\u00bb. Dans le cas examin\u00e9, la Cour d\u2019appel de Catane, par la sentence n\u00b0705\/2017, avait r\u00e9form\u00e9 la sentence de premier degr\u00e9, en d\u00e9clarant l\u2019ill\u00e9gitimit\u00e9 du licenciement ordonn\u00e9 par l\u2019employeur en date du 18 juillet 2005 et ordonnait la r\u00e9int\u00e9gration du requ\u00e9rant \u00e0 son poste de travail, malgr\u00e9 le fait que, dans l\u2019attente du proc\u00e8s, l\u2019activit\u00e9 d\u2019entreprise ait totalement cess\u00e9. Oppos\u00e9 \u00e0 la sentence en appel, l\u2019employeur a d\u00e9pos\u00e9 un recours aupr\u00e8s de la Cassation en se plaignant, entre autres, de la violation et fausse application de l\u2019article 18 de la loi 300\/1970 et de l\u2019article 1463 du code civil. En particulier, selon l\u2019employeur, la Cour aurait omis, dans le jugement en appel, d\u2019examiner les faits d\u00e9cisifs aux fins du jugement de r\u00e9int\u00e9gration, tels que la cessation de l\u2019activit\u00e9 d\u2019entreprise \u00e9tant survenue apr\u00e8s le licenciement et la pr\u00e9sentation de la demande d\u2019admission au concordat pr\u00e9ventif, avec cession des biens aux cr\u00e9anciers homologu\u00e9e par la suite. Selon un principe d\u00e9j\u00e0 exprim\u00e9, la Cour supr\u00eame a consid\u00e9r\u00e9 que la \u00ab&nbsp;r\u00e9int\u00e9gration est un effet de la prononciation, conform\u00e9ment \u00e0 l\u2019art. 18, L. 300\/70, \u00e9trang\u00e8re \u00e0 l\u2019exercice des droits potestatifs de l\u2019employeur, qui peut donc en d\u00e9duire \u00e0 n\u2019importe quel moment l\u2019inapplicabilit\u00e9 totale ou partielle par rapport au cas objet du litige&nbsp;\u00bb (Cassation 28703\/2011).
