Les informations\n\u00e0 l&rsquo;appui de l&rsquo;action avaient \u00e9t\u00e9 recueillies par la soci\u00e9t\u00e9 requ\u00e9rante en acc\u00e9dant\n\u00e0 l&rsquo;adresse de courrier \u00e9lectronique de l&rsquo;ancien salari\u00e9, m\u00eame apr\u00e8s la\ncessation du rapport de travail.<\/p>\n\n\n\n<p>Le salari\u00e9 a ainsi pr\u00e9sent\u00e9 une\nr\u00e9clamation aupr\u00e8s de l\u2019Autorit\u00e9 charg\u00e9e de la protection des donn\u00e9es \u00e0\ncaract\u00e8re personnel, faisant valoir que son ancien employeur n&rsquo;avait pas\nd\u00e9sactiv\u00e9 son compte de courrier \u00e9lectronique et avait acc\u00e9d\u00e9 aux messages\nre\u00e7us dans ce dernier.<\/p>\n\n\n\n<p>La soci\u00e9t\u00e9, dans le cadre de sa r\u00e9ponse\n\u00e0 la r\u00e9clamation d\u00e9pos\u00e9e par le salari\u00e9, a affirm\u00e9 que l\u2019absence de\nd\u00e9sactivation du compte et l&rsquo;acheminement des courriels \u00e0 l&rsquo;adresse du\nresponsable de la fonction informatique, avaient \u00e9t\u00e9 organis\u00e9s car <em>(i)<\/em> l&rsquo;ancien salari\u00e9 avait omis\nd&rsquo;envoyer aux clients une communication avec les nouvelles r\u00e9f\u00e9rences de\nl&rsquo;entreprise. Elle a ajout\u00e9, en outre, que <em>(ii)<\/em>\nseule la correspondance contenant des messages professionnels avait \u00e9t\u00e9 ouverte\net non pas celle personnelle, et que <em>(iii)<\/em>\nl&rsquo;ancien salari\u00e9 \u00e9tait au courant de la<em>\n\u00ab&nbsp;pratique commerciale<\/em>&nbsp;\u00bb selon laquelle l&#8217;employeur, apr\u00e8s la\ncessation du rapport, v\u00e9rifierait la correspondance qui lui \u00e9tait adress\u00e9e. <\/p>\n\n\n\n<p>Prenant acte de ce que les faits en\ncause \u00e9taient ant\u00e9rieurs \u00e0 l&rsquo;entr\u00e9e en vigueur du r\u00e8glement (UE) 2016\/679 et\nque les informations avaient \u00e9t\u00e9 donn\u00e9es aux salari\u00e9s \u00e0 l\u2019oral, <strong>l\u2019Autorit\u00e9 charg\u00e9e de la protection des\ndonn\u00e9es \u00e0 caract\u00e8re personnel <\/strong>a, n\u00e9anmoins, <strong>d\u00e9clar\u00e9 illicite l&rsquo;utilisation r\u00e9p\u00e9t\u00e9e du compte de courrier\n\u00e9lectronique individuel d&rsquo;une personne n&rsquo;appartenant plus \u00e0 une entreprise. <\/strong><\/p>\n\n\n\n<p>L\u2019Autorit\u00e9 charg\u00e9e de la protection des\ndonn\u00e9es \u00e0 caract\u00e8re personnel a en effet affirm\u00e9 que l&#8217;employeur doit agir dans\nle respect des principes de lic\u00e9it\u00e9, de n\u00e9cessit\u00e9 et de proportionnalit\u00e9, qui\nsont les fondements de la protection des donn\u00e9es \u00e0 caract\u00e8re personnel. Elle a\nainsi ordonn\u00e9 la suppression des comptes de courrier \u00e9lectronique d&rsquo;entreprise\nattribuables \u00e0 des personnes identifi\u00e9es ou identifiables. De mani\u00e8re\nconcomitante \u00e0 la cl\u00f4ture du compte, selon l\u2019Autorit\u00e9, l&#8217;employeur est tenu de\nse doter, si n\u00e9cessaire, de syst\u00e8mes automatiques pour informer les tiers et\nleur fournir des adresses de contact alternatives.
