{"id":28021,"date":"2019-06-24T22:00:00","date_gmt":"2019-06-24T20:00:00","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/juste-cause-et-situation-prevue-au-sein-de-la-convention-collective\/"},"modified":"2026-02-16T16:32:11","modified_gmt":"2026-02-16T15:32:11","slug":"juste-cause-et-situation-prevue-au-sein-de-la-convention-collective","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/case-law-fr\/juste-cause-et-situation-prevue-au-sein-de-la-convention-collective\/","title":{"rendered":"Juste cause et situation pr\u00e9vue au sein de la convention collective"},"content":{"rendered":"\n<p>La Cour de cassation italienne, Section droit travail a, par un arr\u00eat n\u00b0\u00a013534 du 20 mai 2019, d\u00e9clar\u00e9 l\u00e9gitime le licenciement pour juste cause prononc\u00e9 \u00e0 l&rsquo;encontre d&rsquo;une salari\u00e9e qui avait r\u00e9agi \u00e0 un affront inflig\u00e9 par un coll\u00e8gue.<\/p>\n\n\n\n<p><strong>Les faits et les degr\u00e9s de juridiction pr\u00e9c\u00e9dents<\/strong><\/p>\n\n\n\n<p>Une salari\u00e9e, charg\u00e9e des ventes, r\u00e9agissant \u00e0 un affront inflig\u00e9 par une coll\u00e8gue, en \u00e9tait venue aux mains avec cette derni\u00e8re, en pr\u00e9sence de la client\u00e8le. La soci\u00e9t\u00e9 qui \u00e9tait son employeur avait, dans ces conditions, mis en \u0153uvre, \u00e0 son encontre, une proc\u00e9dure disciplinaire qui avait d\u00e9bouch\u00e9 sur un licenciement pour juste cause.<\/p>\n\n\n\n<p>Le Tribunal de Sassari saisis par la salari\u00e9e licenci\u00e9e avait consid\u00e9r\u00e9 non l\u00e9gitime la rupture du contrat de travail, en ce que ladite salari\u00e9e s&rsquo;\u00e9tait d\u00e9fendue face \u00e0 un affront dont elle avait \u00e9t\u00e9 victime au pr\u00e9alable.<\/p>\n\n\n\n<p>La Cour d&rsquo;appel de Cagliari, reformant la d\u00e9cision de premi\u00e8re instance, avait d\u00e9clar\u00e9 l\u00e9gitime le licenciement en cause, consid\u00e9rant que la salari\u00e9e, alors qu&rsquo;elle connaissait le caract\u00e8re violent et agressif de sa coll\u00e8gue, avait volontairement cr\u00e9\u00e9 la situation de danger, l&rsquo;intimant, en pr\u00e9sence d&rsquo;autres coll\u00e8gues et de clients, de se comporter d&rsquo;une mani\u00e8re d\u00e9termin\u00e9e.<\/p>\n\n\n\n<p><strong>L&rsquo;arr\u00eat de la Cour de cassation<\/strong><\/p>\n\n\n\n<p>La salari\u00e9e s&rsquo;est pourvue en cassation \u00e0 l&rsquo;encontre de l&rsquo;arr\u00eat prononc\u00e9 par la Cour d&rsquo;appel, invoquant la violation de l\u2019article 2\u00a0219 du Code civil italien et de l&rsquo;article 229 de la Convention collective nationale italienne du travail pour les salari\u00e9s du secteur tertiaire.<\/p>\n\n\n\n<p>De l&rsquo;avis de la salari\u00e9e, la \u00ab <em>dispute litigieuse, suivie de voies de fait en cours de service, y compris entre salari\u00e9s et nuisant \u00e0 l&rsquo;exercice normal de l&rsquo;activit\u00e9 ou troublent ce dernier\u00a0\u00bb, tel que <\/em>pr\u00e9vu \u00e0 l&rsquo;article 229 susvis\u00e9, ne saurait donner lieu \u00e0 un licenciement si, comme en l&rsquo;esp\u00e8ce, la conduite en cause trouve sa justification dans une r\u00e9action face \u00e0 une agression perp\u00e9tr\u00e9e par autrui.<\/p>\n\n\n\n<p>Sur ce point, la Cour de cassation a affirm\u00e9 que \u00ab <strong><em>la convention collective ne lie pas le salari\u00e9 dans un sens d\u00e9favorable \u00e0 ce dernier\u00a0\u00bb<\/em><\/strong><em>.\u00a0<\/em>M\u00eame dans le cas o\u00f9 le comportement du salari\u00e9 se correspond avec une situation pr\u00e9vue dans la convention collective en tant qu&rsquo;une hypoth\u00e8se justifiant le licenciement disciplinaire<em>, \u00ab il convient de se livrer \u00e0 (\u2026)\u00a0<strong>une appr\u00e9ciation in concreto<\/strong>\u00a0\u2013 de la part du juge du fond \u2013\u00a0<strong>de l&rsquo;entit\u00e9 et de la gravit\u00e9 r\u00e9elles du comportement du salari\u00e9, y compris du point de vue subjectif de la faute ou du dol \u00bb <\/strong><\/em>(voir, entre autant d&rsquo;autres, Cass. n\u00b0. 8826\/2017 ; Cass. n\u00b0. 10842\/2016, etc.)<\/p>\n\n\n\n<p>Toujours selon la Cour, \u00ab<em>\u00a0<strong>la liste des hypoth\u00e8ses de juste cause pour un licenciement <\/strong>contenue au sein des conventions collectives <strong>a uniquement une valeur d&rsquo;exemple<\/strong>, de sorte qu&rsquo;elle ne fait pas obstacle \u00e0 la r\u00e9alisation d&rsquo;une appr\u00e9ciation autonome au fond concernant l&rsquo;aptitude d&rsquo;un manquement grave (\u2026) \u00e0 d\u00e9truire le rapport de confiance existant entre l&#8217;employeur et le salari\u00e9\u00a0\u00bb <\/em>(Cass. n\u00b0. 2830\/2016 ; Cass n\u00b0. 4060\/2011, etc.).<\/p>\n\n\n\n<p>Dans un sens oppos\u00e9, en revanche, \u00ab <strong><em>la convention collective lie le salari\u00e9 dans un sens favorable <\/em><\/strong><em>\u00bb<\/em>. En fait, le juge, si les dispositions de la convention collective s&rsquo;av\u00e8rent plus favorables au salari\u00e9 (en ce que la conduite reproch\u00e9e \u00e0 ce dernier y figure parmi les manquements susceptibles d&rsquo;\u00eatre sanctionn\u00e9s par le biais d&rsquo;une mesure conservatoire) ne saurait consid\u00e9rer l\u00e9gitime la rupture du contrat de travail. Il en est ainsi car il y a lieu \u00ab <em>de faire <strong>pr\u00e9valoir l&rsquo;appr\u00e9ciation de moindre gravit\u00e9 du comportement en cause, en tant que manquement disciplinaire d&rsquo;un degr\u00e9 inf\u00e9rieur \u00bb.<\/strong><\/em><\/p>\n\n\n\n<p>Au vu de ce qui pr\u00e9c\u00e8de, de l&rsquo;avis de la Haute Cour, la Cour d&rsquo;appel s&rsquo;est livr\u00e9e \u00e0 une correcte appr\u00e9ciation in concreto des faits, retenant que la conduite de la salari\u00e9e visant \u00e0 provoquer sa coll\u00e8gue n&rsquo;\u00e9tait pas comparable \u00e0 celle de la salari\u00e9e se bornant \u00e0 r\u00e9agir \u00e0 l&rsquo;agression perp\u00e9tr\u00e9e par autrui.
