{"id":28037,"date":"2020-04-01T12:41:22","date_gmt":"2020-04-01T10:41:22","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/salarie-reintegre-sans-lui-confier-de-taches-validite-de-lindemnisation-du-dommage-biologique\/"},"modified":"2026-02-16T16:32:18","modified_gmt":"2026-02-16T15:32:18","slug":"salarie-reintegre-sans-lui-confier-de-taches-validite-de-lindemnisation-du-dommage-biologique","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/case-law-fr\/salarie-reintegre-sans-lui-confier-de-taches-validite-de-lindemnisation-du-dommage-biologique\/","title":{"rendered":"Salari\u00e9 r\u00e9int\u00e9gr\u00e9 sans lui confier de t\u00e2ches : validit\u00e9 de l\u2019indemnisation du dommage biologique"},"content":{"rendered":"\n<p>La Cour de cassation, par son arr\u00eat 6750 du 10 mars 2020, a relev\u00e9 que l\u2019employeur qui r\u00e9trograde un salari\u00e9 le laissant sans t\u00e2ches \u00e0 accomplir, apr\u00e8s l\u2019avoir r\u00e9int\u00e9gr\u00e9 suite \u00e0 la nullit\u00e9 prononc\u00e9e du licenciement, est tenu de l\u2019indemniser s\u2019il a subi un dommage biologique.<\/p>\n\n\n\n<p><strong>Les faits<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Le juge de premi\u00e8re instance accueillait la demande de dommages-int\u00e9r\u00eats d\u2019un salari\u00e9 li\u00e9e \u00e0 sa r\u00e9trogradation et le d\u00e9boutait de sa demande d\u2019indemnisation du dommage biologique. La r\u00e9trogradation avait consist\u00e9 \u00e0 ne pas avoir remis le salari\u00e9 r\u00e9int\u00e9gr\u00e9, suite au prononc\u00e9 de la nullit\u00e9 du licenciement, au poste de directeur d\u2019agence qu\u2019il occupait auparavant.<\/p>\n\n\n\n<p>La Cour d\u2019appel saisie de l\u2019affaire, accueillant partiellement les moyens invoqu\u00e9s par le salari\u00e9, condamnait la banque-employeur \u00e0 la r\u00e9paration du dommage biologique subi (en accueillant partiellement l\u2019appel incident et en r\u00e9formant le jugement de premi\u00e8re instance) mais rejetait sa demande d\u2019indemnisation du dommage d\u2019atteinte au professionnalisme ainsi que ses autres demandes d\u2019indemnisation.<\/p>\n\n\n\n<p>Selon la Cour d\u2019appel, la demande relative au dommage d\u2019atteinte au professionnalisme \u00e9tait irrecevable en ce que le salari\u00e9 n\u2019avait pas illustr\u00e9 les pr\u00e9judices subis suite \u00e0 la r\u00e9trogradation. Les juges admettaient en revanche la demande d\u2019indemnisation du dommage biologique car le salari\u00e9 avait \u00ab&nbsp;invoqu\u00e9 \u00e0 juste titre&nbsp;\u00bb<em> l\u2019inex\u00e9cution de la banque qui l\u2019avait contraint, apr\u00e8s l\u2019avoir r\u00e9int\u00e9gr\u00e9, <\/em>\u00e0 ne rien faire, les pathologies contract\u00e9es et le lien entre ces derni\u00e8res et la r\u00e9trogradation.<\/p>\n\n\n\n<p>La Cour d\u2019appel a estim\u00e9 le dommage, qu\u2019elle a mis \u00e0 la charge exclusive de l\u2019employeur en ce qu\u2019il s\u2019\u00e9levait, en l\u2019esp\u00e8ce, \u00e0 une invalidit\u00e9 de 3% constat\u00e9e par une mesure d\u2019expertise (alors que la loi dispose que seul un dommage \u00e9gal ou sup\u00e9rieur \u00e0 6% peut \u00eatre indemnis\u00e9 par l\u2019INAIL, excluant ainsi, \u00e0 juste titre, toute question de dommage diff\u00e9rentiel &#8211; indemnisation par diff\u00e9rence entre la somme vers\u00e9e par l\u2019INAIL et les dommages et int\u00e9r\u00eats dus par l\u2019employeur au civil).<\/p>\n\n\n\n<p>Le salari\u00e9 se pourvoyait en cassation tandis que la banque formait une demande incidente.<\/p>\n\n\n\n<p><strong>La d\u00e9cision de la Cour de Cassation<\/strong><strong><\/strong><\/p>\n\n\n\n<p>La Cour de cassation, rejetant la demande du salari\u00e9 sur le dommage d\u2019atteinte au professionnalisme, a confirm\u00e9 que celui-ci n\u2019a pas all\u00e9gu\u00e9, pour la p\u00e9riode examin\u00e9e, les pr\u00e9judices d\u00e9coulant de la r\u00e9trogradation. Partant, selon la Cour, sans pr\u00e9judice du manquement de l\u2019employeur \u00e0 ses obligations de rendre au salari\u00e9 les fonctions qu\u2019il occupait auparavant,<em> \u00ab&nbsp;la r\u00e9paration d\u2019un nouveau pr\u00e9judice ne saurait \u00eatre accord\u00e9e, \u00e0 moins de consid\u00e9rer, fait irrecevable, que le dommage d\u2019atteinte au professionnalisme d\u00e9coule purement et simplement de la r\u00e9trogradation<\/em>&nbsp;\u00bb (cfr. Cass. S.U. 26972\/2008, n\u00b0 5067\/2010, n\u00b0 24143\/2010).<\/p>\n\n\n\n<p>En outre, selon la Cour de cassation, les juges du fond ont correctement pris en compte l\u2019argument du salari\u00e9, du caract\u00e8re historique du <strong>manquement de l\u2019employeur<\/strong> qui l\u2019avait laiss\u00e9 pratiquement <strong>sans t\u00e2ches \u00e0 accomplir<\/strong>, de l\u2019<strong>indication des pathologies contract\u00e9es<\/strong> et du <strong>lien de causalit\u00e9<\/strong> entre celles-ci et la r\u00e9trogradation, ainsi que de la <strong>production de la documentation m\u00e9dicale attestant de la maladie et de son lien avec la r\u00e9trogradation<\/strong>.<\/p>\n\n\n\n<p>Selon la Cour de cassation, les juges du fond ont clarifi\u00e9, en termes g\u00e9n\u00e9raux, sur la base de la jurisprudence (cfr. ex multis Cass. 14 octobre 2016, n\u00b0 20807 ; voir aussi Cass. 10 avril 2017, n\u00b0 9166 ; Cass. n\u00b0 27669 de 2017 et n\u00b0 25618 de 2018), que<strong> \u00ab&nbsp;la simple indemnisation par la s\u00e9curit\u00e9 sociale ne saurait \u00eatre consid\u00e9r\u00e9e comme exhaustive du droit \u00e0 la sant\u00e9, prot\u00e9g\u00e9 par la Constitution, devant ainsi admettre la r\u00e9paration int\u00e9grale du dommage biologique<\/strong>&nbsp;\u00bb.<\/p>\n\n\n\n<p>Le salari\u00e9 a en effet fourni tous les moyens n\u00e9cessaires pour obtenir une indemnisation, enti\u00e8rement \u00e0 la charge de l\u2019employeur, en ce que le dommage est inf\u00e9rieur \u00e0 celui qui est couvert par la s\u00e9curit\u00e9 sociale.<\/p>\n\n\n\n<p>En conclusion, la Cour de cassation a rejet\u00e9 tous les griefs et confirm\u00e9 l\u2019arr\u00eat d\u2019appel.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de cassation, par son arr\u00eat 6750 du 10 mars 2020, a relev\u00e9 que l\u2019employeur qui r\u00e9trograde un salari\u00e9 le laissant sans t\u00e2ches \u00e0 accomplir, apr\u00e8s l\u2019avoir r\u00e9int\u00e9gr\u00e9 suite \u00e0 la nullit\u00e9 prononc\u00e9e du licenciement, est tenu de l\u2019indemniser s\u2019il a subi un dommage biologique.
