{"id":28039,"date":"2020-04-01T12:42:47","date_gmt":"2020-04-01T10:42:47","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/licenciement-pour-juste-cause-faute-grave-et-droit-a-la-reintegration\/"},"modified":"2026-02-16T16:32:19","modified_gmt":"2026-02-16T15:32:19","slug":"licenciement-pour-juste-cause-faute-grave-et-droit-a-la-reintegration","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/case-law-fr\/licenciement-pour-juste-cause-faute-grave-et-droit-a-la-reintegration\/","title":{"rendered":"Licenciement pour \u00ab juste cause \u00bb (faute grave) et droit \u00e0 la r\u00e9int\u00e9gration"},"content":{"rendered":"\n<p>La Cour de cassation, par son arr\u00eat du 24 f\u00e9vrier 2020, n\u00b0 4879, a d\u00e9clar\u00e9 que le droit \u00e0 la r\u00e9int\u00e9gration pr\u00e9vu par l\u2019article 18, alin\u00e9a 4, de la Loi 300\/1970 en cas \u00ab&nbsp;d\u2019absence des faits reproch\u00e9s&nbsp;\u00bb s\u2019applique de plus en cas d\u2019inexistence des griefs ou si ceux-ci concernent des faits autres que ceux sur lesquels se base le licenciement.<\/p>\n\n\n\n<p><strong>Les faits de l\u2019affaire<\/strong><strong><\/strong><\/p>\n\n\n\n<p>L\u2019affaire \u00e0 l\u2019origine de la d\u00e9cision de la Haute cour a vu une succession de deux d\u00e9cisions identiques rendues par les juges du fond.<\/p>\n\n\n\n<p>En effet, la Cour d\u2019appel, confirmant le jugement de premi\u00e8re instance, avait prononc\u00e9&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>la nullit\u00e9 du licenciement pour faute contre le salari\u00e9, pour absence du fait mat\u00e9riel reproch\u00e9. Ceci n ce qu\u2019aucune intention mena\u00e7ante n\u2019avait \u00e9t\u00e9 relev\u00e9e dans la phrase<em> \u00ab&nbsp;je n\u2019ai rien \u00e0 perdre, si je me fais du mal, je ne serai pas le seul<\/em>&nbsp;\u00bb prononc\u00e9e par le salari\u00e9 en r\u00e9action au comportement de l\u2019employeur qui lui avait refus\u00e9 des cong\u00e9s au mois d\u2019ao\u00fbt&nbsp;; et<\/li><li>la violation du principe d\u2019inalt\u00e9rabilit\u00e9 de la \u00ab&nbsp;contestation disciplinaire&nbsp;\u00bb (griefs invoqu\u00e9s lors de l\u2019entretien pr\u00e9alable), qui peut \u00eatre d\u00e9duit de l\u2019\u00e9valuation comparative entre les circonstances de fait indiqu\u00e9es lors de l\u2019entretien et les autres circonstances, diff\u00e9rentes, indiqu\u00e9es dans la lettre de licenciement. En effet, cette derni\u00e8re faisait pour la premi\u00e8re fois r\u00e9f\u00e9rence \u00e0 des actions de \u00ab&nbsp;<em>chantage, menace et atteinte \u00e0 l\u2019image de l\u2019entreprise&nbsp;\u00bb <\/em>pr\u00e9tendument mises en \u0153uvre par le salari\u00e9.<\/li><\/ul>\n\n\n\n<p>Enfin, il \u00e9tait \u00e9galement confirm\u00e9 que le salari\u00e9 avait \u00e9t\u00e9 r\u00e9int\u00e9gr\u00e9 \u00e0 juste titre, sans soulever la question de la proportionnalit\u00e9 entre l\u2019expulsion et les faits mineurs reproch\u00e9s.<\/p>\n\n\n\n<p>L\u2019employeur se pourvoyait en cassation, en invoquant le fait que les vices de proc\u00e9dure, m\u00eames s\u2019ils sont graves, ne peuvent que donner lieu \u00e0 une indemnisation r\u00e9duite, tandis que les autres droits sont garantis qu\u2019en cas d\u2019absence de cause r\u00e9elle et s\u00e9rieuse du licenciement.<\/p>\n\n\n\n<p><strong>La d\u00e9cision de la Cour de Cassation<\/strong><strong><\/strong><\/p>\n\n\n\n<p>La Cour de cassation a relev\u00e9 qu\u2019<strong>en pr\u00e9sence d\u2019un licenciement entach\u00e9 de vice de forme<\/strong>, et donc priv\u00e9 de son inefficacit\u00e9, pour <strong>violation de l\u2019obligation de justification<\/strong>, <strong>&nbsp;des dommages-int\u00e9r\u00eats r\u00e9duits sont pr\u00e9vus<\/strong> (toujours en lieu et place de l\u2019emploi), qui varient d\u2019un minimum de 6 \u00e0 un maximum de 12 mois de salaire, en fonction de la gravit\u00e9 du manquement commis (art. 18, alin\u00e9a 6, du <em>Statuto dei Lavoratori<\/em>).<\/p>\n\n\n\n<p>En tout \u00e9tat de cause, selon la Cour de cassation, les autres droits pr\u00e9vus par l\u2019article 18, alin\u00e9as 4, 5 ou 7 s\u2019appliquent &#8211; en remplacement de l\u2019indemnit\u00e9 r\u00e9duite et non pas en compl\u00e9ment de celle-ci &#8211; s\u2019il appara\u00eet, \u00e0 la demande du salari\u00e9, que le licenciement est injustifi\u00e9 (sans cause r\u00e9elle et s\u00e9rieuse). Le licenciement est dit injustifi\u00e9 lorsqu\u2019il n\u2019existe pas de motif justifi\u00e9 subjectif (personnel), objectif, ou une faute grave dont la charge de la preuve, une fois que le salari\u00e9 a effectu\u00e9 sa demande, retombe en tout \u00e9tat de cause sur l\u2019employeur aux termes de l\u2019article n\u00b0&nbsp;5 de la loi 604\/1966.<\/p>\n\n\n\n<p>La Cour de cassation &#8211; confront\u00e9e \u00e0 la question controvers\u00e9e de l\u2019identification du r\u00e9gime de protection applicable en cas d\u2019absence initiale de contestation de certains comportements &#8211; a donc statu\u00e9 que<em> \u00ab&nbsp;lorsqu\u2019il <\/em><em>est<strong> proc\u00e9d\u00e9 \u00e0 un licenciement sans contestation disciplinaire<\/strong><\/em>, il<em> continue, comme par le pass\u00e9, \u00e0 \u00eatre consid\u00e9r\u00e9 comme <strong>injustifi\u00e9<\/strong> et il est donc sanctionn\u00e9 par la r\u00e9int\u00e9gration avec des effets d\u2019indemnisation limit\u00e9s&nbsp;\u00bb<\/em>.<\/p>\n\n\n\n<p>La justification du droit \u00e0 la r\u00e9int\u00e9gration, toujours selon la Cour, r\u00e9side dans le fait que, conform\u00e9ment \u00e0 l\u2019article 18, alin\u00e9a 4, St. Lav., ce droit est pr\u00e9vu en cas <strong>\u00ab&nbsp;d\u2019absence des faits reproch\u00e9s&nbsp;\u00bb<\/strong>, ce qui ne peut implicitement qu\u2019inclure le cas de l\u2019<strong>inexistence<\/strong> de griefs.<\/p>\n\n\n\n<p>Pour toutes ces raisons, le pourvoi de l\u2019employeur a \u00e9t\u00e9 rejet\u00e9, en ce que consid\u00e9r\u00e9 comme non fond\u00e9.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de cassation, par son arr\u00eat du 24 f\u00e9vrier 2020, n\u00b0 4879, a d\u00e9clar\u00e9 que le droit \u00e0 la r\u00e9int\u00e9gration pr\u00e9vu par l\u2019article 18, alin\u00e9a 4, de la Loi 300\/1970 en cas \u00ab&nbsp;d\u2019absence des faits reproch\u00e9s&nbsp;\u00bb s\u2019applique de plus en cas d\u2019inexistence des griefs ou si ceux-ci concernent des faits autres que ceux sur [&hellip;]<\/p>\n","protected":false},"author":5,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[190],"tags":[1221,1081],"class_list":["post-28039","post","type-post","status-publish","format-standard","hentry","category-insights","tag-contestazione-disciplinare-fr","tag-licenziamento-per-giusta-causa-fr"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Licenciement pour \u00ab juste cause \u00bb (faute grave) et droit \u00e0 la r\u00e9int\u00e9gration - De Luca &amp;
