{"id":28076,"date":"2020-05-28T13:35:46","date_gmt":"2020-05-28T11:35:46","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/le-droit-au-teletravail-a-lere-du-covid-19\/"},"modified":"2026-04-08T14:40:43","modified_gmt":"2026-04-08T12:40:43","slug":"le-droit-au-teletravail-a-lere-du-covid-19","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/case-law-fr\/le-droit-au-teletravail-a-lere-du-covid-19\/","title":{"rendered":"Le droit au t\u00e9l\u00e9travail \u00e0 l&rsquo;\u00e8re du Covid-19"},"content":{"rendered":"\n<p>Dans son jugement n<sup>o<\/sup>&nbsp;2759 du 23&nbsp;avril 2020, le Tribunal de Bologne a clarifi\u00e9 l&rsquo;application correcte et la port\u00e9e de l&rsquo;article&nbsp;39 du d\u00e9cret-loi 17\/2020 (appel\u00e9 \u00ab&nbsp;<strong>D\u00e9cret Cura Italia<\/strong>&nbsp;\u00bb), converti par la loi 27\/2020, qui stipule qu\u2019un travailleur en situation de handicap a le droit d&rsquo;exercer son activit\u00e9 en t\u00e9l\u00e9travail.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les faits<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>En mars, une salari\u00e9e avait demand\u00e9, en raison de son handicap, \u00e0 b\u00e9n\u00e9ficier du t\u00e9l\u00e9travail pendant la p\u00e9riode de crise li\u00e9e au coronavirus. Pour appuyer sa demande, la salari\u00e9e avait joint des documents m\u00e9dicaux prouvant un handicap de 60&nbsp;%. Elle pr\u00e9cisait en outre qu&rsquo;elle avait une fille en situation de handicap au sens de l&rsquo;article&nbsp;3, paragraphe&nbsp;3, de la loi 104\/1992.<\/p>\n\n\n\n<p>L&#8217;employeur avait r\u00e9pondu \u00e0 la salari\u00e9e en lui expliquant qu\u2019elle serait temporairement mise au ch\u00f4mage partiel et que les demandes de t\u00e9l\u00e9travail re\u00e7ues seraient examin\u00e9es \u00e0 la reprise de l\u2019activit\u00e9. Cependant, lorsque l\u2019activit\u00e9 de l&rsquo;entreprise a repris, seuls quelques employ\u00e9s ont eu la possibilit\u00e9 de travailler en t\u00e9l\u00e9travail, mais pas la salari\u00e9e en question.<\/p>\n\n\n\n<p>D&rsquo;o\u00f9 la saisie du \u00ab&nbsp;Juge du Travail&nbsp;\u00bb (\u00e9quivalent du Conseil de prud&rsquo;hommes dans le syst\u00e8me juridique italien), en urgence, conform\u00e9ment \u00e0 l&rsquo;article 700 du code de proc\u00e9dure civile italien, visant, d&rsquo;une part, \u00e0 constater l&rsquo;ill\u00e9galit\u00e9 de la d\u00e9cision prise par l&rsquo;entreprise et, d&rsquo;autre part, le droit \u00e0 travailler en t\u00e9l\u00e9travail.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La d\u00e9cision du Tribunal <\/strong><strong><\/strong><\/h2>\n\n\n\n<p>Les sources r\u00e9glementaires qui se sont succ\u00e9d\u00e9 ces derniers mois pour faire face \u00e0 l&rsquo;urgence pand\u00e9mique actuelle ont identifi\u00e9 certaines cat\u00e9gories de travailleurs qui se voient accorder le droit ou la priorit\u00e9 au t\u00e9l\u00e9travail.<\/p>\n\n\n\n<p>En particulier, <strong>ont droit au t\u00e9l\u00e9travail les employ\u00e9s en situation de handicap<\/strong> dans les conditions pr\u00e9vues \u00e0 l&rsquo;article&nbsp;3, paragraphe&nbsp;3, de la loi 104\/1992 ou <strong>dont le foyer compte une personne en situation de handicap<\/strong> dans les conditions pr\u00e9vues \u00e0 l\u2019article pr\u00e9cit\u00e9 et, par ailleurs, <strong>sont prioritaires les travailleurs <\/strong>du secteur priv\u00e9 <strong>souffrant de pathologies graves et av\u00e9r\u00e9es avec une capacit\u00e9 de travail r\u00e9duite<\/strong>.<\/p>\n\n\n\n<p>Sur la base des dispositions r\u00e9glementaires susmentionn\u00e9es, le Tribunal de Bologne a jug\u00e9 fond\u00e9 le droit de la requ\u00e9rante \u00e0 b\u00e9n\u00e9ficier du t\u00e9l\u00e9travail, la qualifiant de <strong>sujet \u00ab&nbsp;fragile&nbsp;\u00bb en raison de sa propre invalidit\u00e9 et parce qu&rsquo;elle avait une fille gravement handicap\u00e9e \u00e0 sa charge<\/strong>. Ces conditions sont suffisantes pour justifier l\u2019existence du <em>fumus boni iuris<\/em> (apparence de bien fond\u00e9 de la demande).<\/p>\n\n\n\n<p>De plus, en ce qui concerne l&rsquo;existence du <em>periculum in mora<\/em> (pr\u00e9judice imminent et irr\u00e9parable), le Tribunal a jug\u00e9 sur le fond de l\u2019affaire que la salari\u00e9e et sa fille \u00e9taient toutes deux<em> \u00ab&nbsp;gravement expos\u00e9es au risque de contagion, y compris de contagion grave, et que l&rsquo;urgence sanitaire [\u00e9tait] toujours d\u2019actualit\u00e9. Il est plus que fond\u00e9 de craindre que l&rsquo;exercice de l&rsquo;activit\u00e9 professionnelle de mani\u00e8re ordinaire, en quittant son domicile pour se rendre au travail, expose la requ\u00e9rante, pendant le temps n\u00e9cessaire pour statuer au fond, au risque d&rsquo;une atteinte imminente et irr\u00e9parable \u00e0 sa sant\u00e9 et \u00e0 celle de sa fille vivant dans le m\u00eame foyer.&nbsp;\u00bb<\/em><\/p>\n\n\n\n<p>Pour ces motifs, le Tribunal de Bologne a valid\u00e9 le recours de la salari\u00e9e et a ordonn\u00e9 \u00e0 l&rsquo;entreprise de lui permettre d&rsquo;exercer ses fonctions en t\u00e9l\u00e9travail, reconnaissant que <strong>le t\u00e9l\u00e9travail \u00e9tait compatible avec les caract\u00e9ristiques du travail effectu\u00e9 <\/strong>et ayant constat\u00e9 que la demanderesse utilisait d\u00e9j\u00e0 couramment le t\u00e9l\u00e9phone et les outils informatiques.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Le pr\u00e9c\u00e9dent du Tribunal de Grosseto<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>Le Tribunal de Grosseto s\u2019est \u00e9galement prononc\u00e9 sur le th\u00e8me du t\u00e9l\u00e9travail \u00e0 l&rsquo;\u00e8re du Covid-19, dans une ordonnance du 23&nbsp;avril 2020. Selon le Tribunal, les <strong>nombreuses mesures d&rsquo;urgence prises dans le but de pr\u00e9venir la propagation du Covid-19 ont consid\u00e9r\u00e9 le recours au t\u00e9l\u00e9travail, r\u00e9gi de fa\u00e7on g\u00e9n\u00e9ral par la loi 81\/2017, comme une priorit\u00e9<\/strong>.<\/p>\n\n\n\n<p>Par cons\u00e9quent, lorsque l&#8217;employeur est en mesure de l&rsquo;appliquer, il ne peut pas, comme dans le cas en examen, exiger que le salari\u00e9 (handicap\u00e9) prenne des cong\u00e9s. L\u2019utilisation des cong\u00e9s pay\u00e9s, selon le Tribunal,<em> \u00ab&nbsp;ne peut \u00eatre g\u00e9n\u00e9ralis\u00e9e, injustifi\u00e9e ou p\u00e9nalisante, notamment lorsqu&rsquo;il existe des droits prioritaires pour des raisons de sant\u00e9<\/em>&nbsp;\u00bb.<\/p>\n\n\n\n<p>Dans un souci d&rsquo;exhaustivit\u00e9, il convient de noter que l&rsquo;importance croissante du t\u00e9l\u00e9travail dans ce contexte \u00e9pid\u00e9miologique a \u00e9t\u00e9 confirm\u00e9e en dernier lieu par le D\u00e9cret Relance. Ce d\u00e9cret reconna\u00eet notamment, <strong>jusqu&rsquo;\u00e0 la lev\u00e9e de l&rsquo;\u00e9tat d&rsquo;urgence et, en tout \u00e9tat de cause, au plus tard le 31&nbsp;d\u00e9cembre 2020, le droit au t\u00e9l\u00e9travail pour les parents d\u2019enfants de moins de 14&nbsp;ans<\/strong> lorsque l\u2019exercice de leurs fonctions est compatible avec ce mode de travail.
