{"id":28093,"date":"2020-06-29T15:41:07","date_gmt":"2020-06-29T13:41:07","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/coordination-entre-le-decret-loi-cura-italia-et-le-decret-loi-rilancio-note-de-linspection-nationale-du-travail-n-160-du-3-juin-2020\/"},"modified":"2026-02-16T16:32:45","modified_gmt":"2026-02-16T15:32:45","slug":"coordination-entre-le-decret-loi-cura-italia-et-le-decret-loi-rilancio-note-de-linspection-nationale-du-travail-n-160-du-3-juin-2020","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/coordination-entre-le-decret-loi-cura-italia-et-le-decret-loi-rilancio-note-de-linspection-nationale-du-travail-n-160-du-3-juin-2020\/","title":{"rendered":"Coordination entre le d\u00e9cret-loi \u00abCura Italia\u00bb et le d\u00e9cret loi \u00abRilancio\u00bb : note de l\u2019Inspection Nationale du Travail n\u00b0 160 du 3 juin 2020"},"content":{"rendered":"\n<p>Par la note n\u00b0 160 du 3 juin 2020, l&rsquo;Inspection Nationale du Travail a apport\u00e9 quelques pr\u00e9cisions concernant les modifications apport\u00e9es par le d\u00e9cret-loi n\u00b0 34\/2020 (\u00abd\u00e9cret-loi<strong> Rilancio\u00bb<\/strong>) au d\u00e9cret-loi n\u00b0 18\/2020 (\u00abd\u00e9cret-loi<strong> \u00abCura Italia\u00bb<\/strong>) converti par la loi n\u00b0 27\/2020, afin d&rsquo;aider l&rsquo;interpr\u00e8te dans l&rsquo;analyse des diff\u00e9rentes dispositions r\u00e9glementaires qui se sont succ\u00e9d\u00e9es et superpos\u00e9es au cours des derniers mois.<\/p>\n\n\n\n<p>Les principales indications fournies par l&rsquo;Inspection concernent l&rsquo;interdiction de licenciement en vertu de l&rsquo;art. 46 du d\u00e9cret-loi \u00abCura Italia\u00bb et les r\u00e8gles d\u00e9rogatoires sur les contrats \u00e0 terme introduites pendant l&rsquo;urgence li\u00e9e au Covid-19.<\/p>\n\n\n\n<p><strong>Modifications \u00e0 l&rsquo;art. 46 du d\u00e9cret-loi \u00abCura Italia\u00bb: licenciements \u00e9conomiques, collectifs et individuels<\/strong><strong><\/strong><\/p>\n\n\n\n<p>En ce qui concerne le premier point, l&rsquo;Inspection Nationale du Travail a rappel\u00e9 que lorsque le d\u00e9cret-loi \u00abCura Italia\u00bb a \u00e9t\u00e9 converti en loi, on a introduit une exclusion sp\u00e9cifique de l&rsquo;interdiction de licenciement dans le cadre des march\u00e9s et, pr\u00e9cis\u00e9ment, dans le cas o\u00f9<em> \u00ab\u00a0le personnel touch\u00e9 par le licenciement, employ\u00e9 dans le cadre du march\u00e9, serait r\u00e9embauch\u00e9 suite \u00e0 la subrogation d&rsquo;un nouveau contractant<\/em>\u00ab\u00a0. Il s&rsquo;ensuit &#8211; comme indiqu\u00e9 dans la note en commentaire &#8211; que l&rsquo;interdiction des licenciements \u00e9conomiques, collectifs et individuels, ne s&rsquo;applique pas lorsque le nouveau contractant absorbe le personnel employ\u00e9 dans le cadre du march\u00e9. Si, en revanche, le personnel n&rsquo;est pas r\u00e9absorb\u00e9, cette interdiction demeure chez le contractant sortant.<\/p>\n\n\n\n<p>Toujours en ce qui concerne les licenciements, l\u2019Inspection Nationale du Travail a rappel\u00e9 que le d\u00e9cret-loi \u00abRilancio\u00bb a prolong\u00e9 les termes de l&rsquo;interdiction relative de cinq mois, \u00e0 compter du 17 mars 2020 : pendant cette p\u00e9riode, les proc\u00e9dures de licenciement collectif ne peuvent \u00eatre engag\u00e9es et celles qui sont en cours, engag\u00e9es apr\u00e8s le 23 f\u00e9vrier, sont suspendues pour la m\u00eame p\u00e9riode.<\/p>\n\n\n\n<p>De m\u00eame, l&rsquo;interdiction de licenciement \u00e9conomique pr\u00e9vue \u00e0 l&rsquo;article 7, paragraphe L, de la loi n\u00b0 604\/1966, a \u00e9t\u00e9 prorog\u00e9e pour la m\u00eame p\u00e9riode, avec la pr\u00e9cision que les proc\u00e9dures de licenciement \u00e9conomique en cours sont suspendues.<\/p>\n\n\n\n<p>Aucune pr\u00e9cision n&rsquo;est fournie concernant la fen\u00eatre temporelle d\u00e9termin\u00e9e par le retard dans la publication du d\u00e9cret-loi. 34\/2020 (19 mai 2020) par rapport \u00e0 l&rsquo;expiration de l&rsquo;interdiction initiale, le 16 mai, pr\u00e9vue par le d\u00e9cret-loi n\u00b0 34\/2020 : il ne peut \u00eatre soumis qu&rsquo;\u00e0 l&rsquo;interpr\u00e9tation des tribunaux, \u00e9tant entendu que la non-r\u00e9troactivit\u00e9 des r\u00e8gles peut difficilement \u00eatre surmont\u00e9e.<\/p>\n\n\n\n<p>Enfin, l\u2019Inspection Nationale du Travail rappelle que le d\u00e9cret-loi \u00abRilancio\u00bb a introduit l\u2019alin\u00e9a 1bis qui permet \u00e0 l\u2019employeur ayant proc\u00e9d\u00e9 \u00e0 des licenciements \u00e9conomiques pendant la p\u00e9riode allant du 23 f\u00e9vrier au 17 mars 2020 de r\u00e9voquer le licenciement \u00e0 tout moment, \u00e0 condition qu&rsquo;il demande en m\u00eame temps le ch\u00f4mage partiel \u00e0 partir de la date \u00e0 laquelle le licenciement prend effet. Dans ce cas, le rapport de travail est consid\u00e9r\u00e9 comme r\u00e9tabli sans interruption, sans charge ni p\u00e9nalit\u00e9 pour l&#8217;employeur.<\/p>\n\n\n\n<p><strong>Prolongation ou renouvellement du contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e : d\u00e9rogation \u00e0 l&rsquo;art. 21 du d\u00e9cret l\u00e9gislatif n\u00b0 81\/2015<\/strong><strong><\/strong><\/p>\n\n\n\n<p>En ce qui concerne les contrats \u00e0 terme, l&rsquo;Inspection Nationale du Travail a apport\u00e9 des pr\u00e9cisions concernant la d\u00e9rogation \u00e0 l&rsquo;art. 21 du D\u00e9cret l\u00e9gislatif n\u00b0 81\/2015 introduite par le d\u00e9cret-loi \u00abRilancio\u00bb, qui permet de renouveler ou de prolonger jusqu&rsquo;au 30 ao\u00fbt 2020 les contrats de travail subordonn\u00e9 \u00e0 dur\u00e9e d\u00e9termin\u00e9e en vigueur au 23 f\u00e9vrier 2020, m\u00eame en l&rsquo;absence des causes r\u00e9gies par l&rsquo;art. 19, alin\u00e9a 1, du d\u00e9cret l\u00e9gislatif n\u00b0 81\/2015.<\/p>\n\n\n\n<p>Avec la note en commentaire, l&rsquo;Inspection Nationale du Travail a pr\u00e9cis\u00e9 que, aux fins de la prolongation ou du renouvellement sans cause vis\u00e9s \u00e0 la disposition pr\u00e9vue au d\u00e9cret-loi \u00abRilancio\u00bb, deux conditions doivent \u00eatre remplies :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>le contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e doit \u00eatre en vigueur le 23 f\u00e9vrier 2020 (par cons\u00e9quent, les contrats conclus pour la premi\u00e8re fois apr\u00e8s le 23 f\u00e9vrier sont exclus de la d\u00e9rogation) ;<\/li><li>le contrat de travail prolong\u00e9 ou renouvel\u00e9 doit \u00eatre r\u00e9sili\u00e9 avant le 30 ao\u00fbt 2020.<\/li><\/ul>\n\n\n\n<p>Il est \u00e9vident qu&rsquo;il existe toujours la possibilit\u00e9 d&rsquo;une prolongation sans cause m\u00eame au-del\u00e0 du 30 ao\u00fbt si cette derni\u00e8re n\u2019entraine pas un d\u00e9passement de la p\u00e9riode de 12 mois.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Par la note n\u00b0 160 du 3 juin 2020, l&rsquo;Inspection Nationale du Travail a apport\u00e9 quelques pr\u00e9cisions concernant les modifications apport\u00e9es par le d\u00e9cret-loi n\u00b0 34\/2020 (\u00abd\u00e9cret-loi Rilancio\u00bb) au d\u00e9cret-loi n\u00b0 18\/2020 (\u00abd\u00e9cret-loi \u00abCura Italia\u00bb) converti par la loi n\u00b0 27\/2020, afin d&rsquo;aider l&rsquo;interpr\u00e8te dans l&rsquo;analyse des diff\u00e9rentes dispositions r\u00e9glementaires qui se sont succ\u00e9d\u00e9es et [&hellip;]<\/p>\n","protected":false},"author":5,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[175,190,204],"tags":[1378],"class_list":{"0":"post-28093","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"hentry","6":"category-insights","8":"category-practice","9":"tag-licenziamenti-collettivi-fr"},"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Coordination entre le d\u00e9cret-loi \u00abCura Italia\u00bb et le d\u00e9cret loi \u00abRilancio\u00bb : note de l\u2019Inspection Nationale du Travail n\u00b0 160 du 3 juin 2020 - De Luca &amp;
