{"id":28107,"date":"2020-08-31T10:00:22","date_gmt":"2020-08-31T08:00:22","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/transfert-illegitime-dentreprise-et-double-remuneration\/"},"modified":"2026-02-16T16:32:52","modified_gmt":"2026-02-16T15:32:52","slug":"transfert-illegitime-dentreprise-et-double-remuneration","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/case-law-fr\/transfert-illegitime-dentreprise-et-double-remuneration\/","title":{"rendered":"Transfert ill\u00e9gitime d\u2019entreprise et \u00ab double r\u00e9mun\u00e9ration \u00bb"},"content":{"rendered":"\n<p>Le Tribunal de Trente, dans son arr\u00eat n\u00b0 86\/2020, a rouvert la question dite de la \u00ab&nbsp;double r\u00e9mun\u00e9ration&nbsp;\u00bb des travailleurs dont la relation de travail change de titulaire par l\u2019effet d\u2019un acte de cession d\u2019entreprise, dans le cas o\u00f9 un tel transfert serait d\u00e9clar\u00e9 ill\u00e9gitime. \u00c0 noter qu\u2019il existait d\u00e9j\u00e0 une jurisprudence contrast\u00e9e sur cette question.<\/p>\n\n\n\n<p>Selon une d\u00e9cision r\u00e9cente de la Cour de cassation italienne (arr\u00eat n\u00b0 9093\/2020), dans le cas pr\u00e9cit\u00e9 une double r\u00e9mun\u00e9ration doit \u00eatre reconnue au travailleur&nbsp;; en cons\u00e9quence, l\u2019employeur qui c\u00e8de l\u2019entreprise, le c\u00e9dant, ne pourrait pas d\u00e9duire de traitements ou salaires dus dans le pass\u00e9 de ce que le travailleur aurait per\u00e7u, \u00e0 titre de r\u00e9mun\u00e9ration, pour l\u2019activit\u00e9 r\u00e9alis\u00e9e en faveur de l\u2019\u00ab&nbsp;ancien cessionnaire&nbsp;\u00bb.<\/p>\n\n\n\n<p>Le Tribunal de Trente s\u2019\u00e9carte de cette interpr\u00e9tation et exclut que le travailleur, suite \u00e0 l\u2019annulation du transfert d\u2019entreprise, puisse faire partie de deux prestations (une \u00ab&nbsp;prestation mat\u00e9rielle&nbsp;\u00bb \u00e0 l\u2019\u00e9gard de l\u2019ancien cessionnaire et une \u00ab&nbsp;prestation juridique&nbsp;\u00bb \u00e0 l\u2019\u00e9gard de l\u2019ancien c\u00e9dant qui na\u00eetrait comme effet de l\u2019arr\u00eat).
