{"id":28115,"date":"2020-08-31T12:49:54","date_gmt":"2020-08-31T10:49:54","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/lemployeur-peut-decider-unilateralement-de-ne-plus-distribuer-de-tickets-repas\/"},"modified":"2026-02-16T16:32:54","modified_gmt":"2026-02-16T15:32:54","slug":"lemployeur-peut-decider-unilateralement-de-ne-plus-distribuer-de-tickets-repas","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/case-law-fr\/lemployeur-peut-decider-unilateralement-de-ne-plus-distribuer-de-tickets-repas\/","title":{"rendered":"L\u2019employeur peut d\u00e9cider unilat\u00e9ralement de ne plus distribuer de tickets repas"},"content":{"rendered":"\n<p>La Cour de cassation, par son ordonnance n\u00b0 16135 du 28 juillet 2020, a statu\u00e9 que les tickets repas ne font pas partie de la r\u00e9mun\u00e9ration et qu\u2019en cons\u00e9quence, l\u2019employeur peut d\u00e9cider unilat\u00e9ralement de ne plus en distribuer.<\/p>\n\n\n\n<p><strong>Les faits<\/strong><strong><\/strong><\/p>\n\n\n\n<p>L\u2019action a \u00e9t\u00e9 introduite par un salari\u00e9 au tribunal demandant de (i) dire que la d\u00e9cision unilat\u00e9rale de l\u2019employeur d\u2019interrompre la distribution des tickets repas est abusive et, en cons\u00e9quence, (ii) le condamner au paiement en sa faveur des diff\u00e9rences de r\u00e9mun\u00e9ration correspondantes.<\/p>\n\n\n\n<p>D\u00e9bout\u00e9 de sa demande, le salari\u00e9 interjetait appel de la d\u00e9cision qui confirmait le jugement de premi\u00e8re instance. Le salari\u00e9 se pourvoyait alors en cassation.<\/p>\n\n\n\n<p><strong>La d\u00e9cision de la Cour de Cassation<\/strong><strong><\/strong><\/p>\n\n\n\n<p>La Cour de cassation a confirm\u00e9 la d\u00e9cision au fond selon laquelle <strong>les tickets repas ne repr\u00e9sentent pas un \u00e9l\u00e9ment de la r\u00e9mun\u00e9ration<\/strong>, mais <strong>une aide li\u00e9e au contrat de travail ayant nature strictement occasionnelle<\/strong>.<\/p>\n\n\n\n<p>En cons\u00e9quence, ne faisant pas partie de la r\u00e9mun\u00e9ration au sens strict, <strong>la distribution des tickets repas peut \u00eatre modifi\u00e9e, sur d\u00e9cision unilat\u00e9rale de l\u2019employeur, sans qu\u2019il soit besoin de la formaliser par un accord syndical,<\/strong> dans la mesure o\u00f9 il s\u2019agit d\u2019un \u00ab&nbsp;<em>acte interne<\/em>&nbsp;\u00bb.<\/p>\n\n\n\n<p>L\u2019ordonnance ajoute que l\u2019on ne saurait de plus opposer \u00e0 l\u2019employeur le fait que la distribution des tickets repas est r\u00e9p\u00e9t\u00e9e dans le temps, m\u00eame s\u2019il s\u2019agit d\u2019un usage.<\/p>\n\n\n\n<p>En conclusion, la Haute Cour a rejet\u00e9 le pourvoi du salari\u00e9 et confirm\u00e9 la l\u00e9gitimit\u00e9 du geste de l\u2019employeur.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de cassation, par son ordonnance n\u00b0 16135 du 28 juillet 2020, a statu\u00e9 que les tickets repas ne font pas partie de la r\u00e9mun\u00e9ration et qu\u2019en cons\u00e9quence, l\u2019employeur peut d\u00e9cider unilat\u00e9ralement de ne plus en distribuer.
