La condition de la rapidit\u00e9 de la r\u00e9siliation pour d\u00e9passement de la p\u00e9riode de cong\u00e9 maladie, selon la Cour de Cassation, ne peut se limiter \u00e0 une donn\u00e9e chronologique fixe et pr\u00e9d\u00e9termin\u00e9e, mais doit faire l\u2019objet d\u2019une \u00e9valuation quant \u00e0\u00a0 sa pertinence, effectu\u00e9e de fa\u00e7on concr\u00e8te en la repla\u00e7ant dans le contexte des faits dans leur ensemble. Par cons\u00e9quent, m\u00eame un laps de temps significatif entre le d\u00e9passement de la p\u00e9riode de cong\u00e9 maladie et le moment o\u00f9 l\u2019employeur d\u00e9cide de notifier le licenciement doit \u00eatre consid\u00e9r\u00e9 comme conforme aux dispositions l\u00e9gales. Ce \u00e0 la condition que l\u2019employeur utilise cet intervalle interm\u00e9diaire pour contr\u00f4ler la compatibilit\u00e9 de la maladie par rapport \u00e0 la prestation demand\u00e9e au salari\u00e9.
