En l\u2019esp\u00e8ce, le travailleur, \u00e0 l\u2019\u00e9ch\u00e9ance du premier contrat, avait manifest\u00e9 son int\u00e9r\u00eat pour un autre poste, pour lequel il avait d\u00e9but\u00e9 une proc\u00e9dure de s\u00e9lection, en signant un <em>\u00abformulaire de d\u00e9claration d\u2019indication du poste de travail souhait\u00e9\u00bb.<\/em> Dans ce formulaire, il \u00e9tait notamment d\u00e9clar\u00e9 que l\u2019embauche aurait \u00e9t\u00e9 subordonn\u00e9e \u00e0 la pr\u00e9sentation de toute la documentation pr\u00e9vue par la CCNT du secteur. Parmi les documents requis par l\u2019entreprise, figurait un extrait de casier judiciaire, que le candidat avait refus\u00e9 de pr\u00e9senter.<\/p>\n\n\n\n<p>Le Tribunal et la Cour d\u2019Appel saisis par le travailleur avaient soulign\u00e9 que la CCNT du secteur ne mentionnait pas l\u2019extrait de casier judiciaire parmi les documents \u00e0 pr\u00e9senter pendant la phase de s\u00e9lection. De ce fait, la soci\u00e9t\u00e9 n\u2019aurait pas pu consid\u00e9rer la pr\u00e9sentation de l\u2019extrait de casier judiciaire comme une condition emp\u00eachant l\u2019embauche du candidat.<\/p>\n\n\n\n<p>Contre cette d\u00e9cision au fond, la soci\u00e9t\u00e9 succombante s\u2019est pourvue en cassation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La d\u00e9cision de la Cour de Cassation<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>La Cour de Cassation a adopt\u00e9 une position oppos\u00e9e \u00e0 celle des juges du fond, en affirmant que l\u2019employeur doit toujours avoir la possibilit\u00e9 d\u2019effectuer une libre \u00e9valuation de l\u2019aptitude du candidat \u00e0 remplir les fonctions requises pour le poste objet de la s\u00e9lection. La d\u00e9cision de la part de l\u2019employeur d\u2019exiger la pr\u00e9sentation d\u2019un extrait de casier judiciaire, selon la Cour de Cassation, est <strong><em>\u00abcoh\u00e9rente avec les principes g\u00e9n\u00e9raux de correction et de bonne foi qui gouvernent m\u00eame la phase pr\u00e9-contractuelle en mati\u00e8re de droit du travail\u00bb<\/em><\/strong>. Par cons\u00e9quent, la reconnaissance du droit de v\u00e9rifier l\u2019aptitude du candidat ne peut \u00eatre limit\u00e9e par l\u2019absence d\u2019une indication sp\u00e9cifique de la convention collective nationale appliqu\u00e9e en l\u2019esp\u00e8ce.<\/p>\n\n\n\n<p>La Cour de Cassation a donc consid\u00e9r\u00e9 comme l\u00e9gitime la d\u00e9cision de la soci\u00e9t\u00e9 de ne pas embaucher le candidat pour ne pas avoir remis l\u2019extrait de casier judiciaire. Ce parce que ce dernier n\u2019aurait pas rempli les conditions d\u2019aptitude requises pour satisfaire les exigences de fiabilit\u00e9 n\u00e9cessaires pour exercer les fonctions objet de la s\u00e9lection.<\/p>\n\n\n\n<p>Selon les juges de la Cour de Cassation, donc, l\u2019employeur peut unilat\u00e9ralement exiger la pr\u00e9sentation de documents d\u00e9termin\u00e9s, \u00e0 la condition qu\u2019ils permettent d\u2019\u00e9valuer l\u2019aptitude ou non du candidat \u00e0 occuper le poste \u00e0 pourvoir.
