L\u2019important est qu\u2019il n\u2019aboutisse pas \u00e0 une simple fourniture de personnel \u00e0 autrui.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les faits<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>En l\u2019esp\u00e8ce, le travailleur d\u2019un constructeur automobile, traversant une crise de production temporaire, avait \u00e9t\u00e9 d\u00e9tach\u00e9 dans une entreprise de fabrication de pi\u00e8ces m\u00e9caniques pour automobiles. D\u00e9tachement d\u00e9cid\u00e9 pour ne pas perdre le patrimoine professionnel du travailleur et, donc, pour augmenter sa \u00abpolyvalence fonctionnelle individuelle\u00bb. Ce d\u00e9tachement, de plus, avait entra\u00een\u00e9 la modification des fonctions assign\u00e9es au travailleur et la distance entre les deux soci\u00e9t\u00e9s (d\u00e9tachante et d\u2019accueil) \u00e9tait sup\u00e9rieure \u00e0 50 kilom\u00e8tres.<\/p>\n\n\n\n<p>La Cour d\u2019Appel, r\u00e9formant la sentence de premier degr\u00e9, avait rejet\u00e9 la demande du travailleur, qui visait \u00e0 obtenir la constitution d\u2019une relation de travail avec l\u2019entreprise d\u2019accueil, pour carence de conditions l\u00e9gitimant le d\u00e9tachement.<\/p>\n\n\n\n<p>Selon la Cour d\u2019Appel, en effet, l\u2019int\u00e9r\u00eat l\u00e9gitime de l\u2019entreprise d\u00e9tachante consistait en l\u2019utilit\u00e9 de ne pas perdre, pendant la crise temporaire de production, le patrimoine professionnel de l\u2019entreprise constitu\u00e9 par les comp\u00e9tences de chaque salari\u00e9, y compris le travailleur requ\u00e9rant.<\/p>\n\n\n\n<p>Le travailleur s\u2019est pourvu en cassation contre cette d\u00e9cision au fond.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La d\u00e9cision de la Cour de Cassation<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>La Cour de Cassation, confirmant la d\u00e9cision au fond, a affirm\u00e9 que <strong>l\u2019int\u00e9r\u00eat du d\u00e9tachement peut aussi \u00eatre de nature non \u00e9conomique ou patrimoniale au sens strict<\/strong>. En l\u2019esp\u00e8ce, en effet, l\u2019int\u00e9r\u00eat de l\u2019entreprise d\u00e9tachante a consist\u00e9 \u00e0 augmenter la polyvalence professionnelle du travailleur, dans un contexte de crise temporaire de l\u2019entreprise et dans l\u2019attente d\u2019une reprise de la production. Les fonctions confi\u00e9es au salari\u00e9 d\u00e9tach\u00e9, en effet, \u00e9taient diff\u00e9rentes de celles exerc\u00e9es dans l\u2019entreprise d\u2019accueil, avec une am\u00e9lioration de ses capacit\u00e9s professionnelles.<\/p>\n\n\n\n<p>De plus, la Cour de Cassation a d\u00e9cid\u00e9 que la violation de la r\u00e8gle pr\u00e9vue par l\u2019alin\u00e9a 3 de l\u2019art. 30 du d\u00e9cret l\u00e9gislatif italien n\u00b0 276\/2003 (d\u00e9tachement entra\u00eenant un changement dans les fonctions n\u00e9cessitant l\u2019accord des travailleurs et d\u00e9tachement avec transfert vers une unit\u00e9 de production situ\u00e9e \u00e0 plus de 50 km de celle o\u00f9 le travailleur est affect\u00e9, qui n\u00e9cessite l\u2019existence de raisons techniques, d\u2019organisation, productives et substitutives prouv\u00e9es) ne doit pas \u00eatre sanctionn\u00e9e par la protection constitutive, \u00e0 la diff\u00e9rence de l\u2019hypoth\u00e8se vis\u00e9e \u00e0 l\u2019alin\u00e9a 1 du m\u00eame article.<\/p>\n\n\n\n<p>Selon la Cour de Cassation, <strong>la possibilit\u00e9 que le travailleur concern\u00e9 puisse demander la constitution d\u2019une relation de travail comme salari\u00e9 de l\u2019entreprise d\u2019accueil est<\/strong> textuellement <strong>pr\u00e9vue seulement pour le cas de l\u2019art. 30, alin\u00e9a 1, du D\u00e9cret-loi n\u00b0 276\/ 2003 et non pas pour le cas pr\u00e9vu \u00e0 l\u2019alin\u00e9a 3<\/strong>.<\/p>\n\n\n\n<p>Selon la Cour de Cassation, l\u2019intention du l\u00e9gislateur est de pr\u00e9voir que soit attribu\u00e9e <strong>\u00e0 l\u2019hypoth\u00e8se consid\u00e9r\u00e9e plus grave du d\u00e9tachement<\/strong> sans les conditions de l\u2019int\u00e9r\u00eat et du caract\u00e8re temporaire la <strong>protection de droit civil de type \u00abconstitutif\u00bb et la sanction de caract\u00e8re \u00abadministratif\u00bb<\/strong> (avant que de caract\u00e8re p\u00e9nal), tandis que <strong>pour les hypoth\u00e8ses pr\u00e9vues par l\u2019alin\u00e9a 3, seule la protection de droit civil \u00e0 titre d\u2019\u00abindemnisation\u00bb doit \u00eatre reconnue<\/strong>.<\/p>\n\n\n\n<p>Ce raisonnement, selon la Cour de Cassation, est raisonnable et \u00e9quilibr\u00e9 par rapport aux int\u00e9r\u00eats sous-jacents des parties \u00e0 ce qu\u2019un travailleur puisse exercer sa prestation aupr\u00e8s d\u2019une personne autre son employeur, en pr\u00e9sence de conditions d\u00e9termin\u00e9es et\/ou au travers de modalit\u00e9s spatio-temporelles particuli\u00e8res: en effet, le fait que dans la structure de ce droit les conditions fondamentales de l\u2019int\u00e9r\u00eat et du caract\u00e8re temporaire font d\u00e9faut est une chose; une autre, en revanche, est la mani\u00e8re selon laquelle le d\u00e9tachement est r\u00e9alis\u00e9 et cette derni\u00e8re hypoth\u00e8se, qui n\u2019est pas en opposition avec les fondements de ce droit, justifie pleinement une protection diff\u00e9rente.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Autres insights connexes:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.delucapartners.it\/fr\/insights\/detachement-transnational-le-decret-dapplication-a-ete-publie-au-jo-italien\/\">D\u00e9tachement transnational: le d\u00e9cret d\u2019application a \u00e9t\u00e9 publi\u00e9 au JO italien<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.delucapartners.it\/fr\/insights\/normativa\/la-nouvelle-reforme-du-detachement-transnational\/\">La nouvelle r\u00e9forme du d\u00e9tachement transnational<\/a><\/li>\n<\/ul>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de cassation, par son arr\u00eat n\u00b0 18959\/2020, a affirm\u00e9 que l\u2019int\u00e9r\u00eat du d\u00e9tachement peut aussi \u00eatre de nature non \u00e9conomique ou patrimoniale au sens strict, mais peut \u00eatre li\u00e9 \u00e0 des consid\u00e9rations de solidarit\u00e9.
