{"id":28149,"date":"2021-01-05T14:05:13","date_gmt":"2021-01-05T13:05:13","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/reglements-internes-clauses-penales-exigibles-seulement-si-objet-dacceptation-specifique\/"},"modified":"2026-02-16T16:33:10","modified_gmt":"2026-02-16T15:33:10","slug":"reglements-internes-clauses-penales-exigibles-seulement-si-objet-dacceptation-specifique","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/case-law-fr\/reglements-internes-clauses-penales-exigibles-seulement-si-objet-dacceptation-specifique\/","title":{"rendered":"R\u00e8glements internes : clauses p\u00e9nales exigibles seulement si objet d\u2019acceptation sp\u00e9cifique"},"content":{"rendered":"\n<p>La Cour de cassation, par son arr\u00eat n\u00b0 27422 du 1<sup>er<\/sup> d\u00e9cembre 2020, a \u00e9nonc\u00e9 que la clause de la convention collective nationale selon laquelle les travailleurs sont appel\u00e9s \u00e0 respecter non seulement les dispositions qui y sont contenues mais aussi celles pr\u00e9vues dans les r\u00e8glements internes n\u2019oblige pas automatiquement les salari\u00e9s \u00e0 verser un d\u00e9dommagement, en cas de violation \u00e9ventuelle de ses dispositions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les faits<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>En l\u2019esp\u00e8ce, une entreprise avait effectu\u00e9 une retenue sur la fiche de salaire d\u2019un salari\u00e9 en raison d\u2019une n\u00e9gligence de ce dernier dans la surveillance de 56 billets, qui lui avaient \u00e9t\u00e9 soustraits lors du vol d\u2019une sacoche. Cela en vertu d\u2019une disposition contenue dans une circulaire interne, pr\u00e9c\u00e9demment communiqu\u00e9e aux salari\u00e9s, selon laquelle, en cas de perte des billets, il existait \u00e0 leur charge une obligation de d\u00e9dommagement d\u2019un montant d\u00e9termin\u00e9. Selon l\u2019entreprise, cette disposition \u00e9tait imm\u00e9diatement applicable justement en vertu du rappel contenu dans la CCNT du secteur aux r\u00e8glements internes, que les salari\u00e9s devaient respecter. La Cour de Cassation n\u2019a pas \u00e9t\u00e9 de cet avis.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La d\u00e9cision de la Cour de Cassation<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>Selon la Cour de Cassation, <strong>la pr\u00e9vision d\u2019un dommage indemnisable dans une circulaire ou un r\u00e8glement interne en cas de violation d\u2019une de ses dispositions \u00e9quivaut \u00e0 une clause p\u00e9nale<\/strong> qui, en tant que telle, oblige les salari\u00e9s seulement en cas d\u2019acceptation expresse de leur part.<\/p>\n\n\n\n<p>Selon la Cour de Cassation, la <strong>clause p\u00e9nale est un moyen qui vient renforcer des obligations contractuelles sp\u00e9cifiques <\/strong>et elle se pr\u00e9sente comme une \u00ab <em>liquidation convenue anticip\u00e9e \u00bb<\/em> du dommage d\u00e9rivant de leur violation. La clause p\u00e9nale suppose, de par ses caract\u00e9ristiques, la <strong>rencontre de volont\u00e9s <\/strong>que les parties formalisent par un acte, dont l\u2019absence emp\u00eache d\u2019en exiger l\u2019application. La pr\u00e9vision de la clause p\u00e9nale <strong>ne fait pas partie des pouvoirs unilat\u00e9raux de l\u2019employeur<\/strong>, dans la mesure o\u00f9 sa n\u00e9gociation sp\u00e9cifique et son approbation formelle en sont une condition irrempla\u00e7able.<\/p>\n\n\n\n<p>Par cons\u00e9quent, les r\u00e8glements, les circulaires ou les ordres de service qui pr\u00e9voient une obligation de d\u00e9dommagement d\u2019une somme d\u00e9termin\u00e9e, pour \u00eatre obligatoires, ne peuvent \u00eatre simplement communiqu\u00e9s ou affich\u00e9s au registre de l\u2019entreprise.
