Il s\u2019agit d\u2019une modalit\u00e9 flexible d\u2019ex\u00e9cution de la prestation de travail, dans le cadre de la relation de travail subordonn\u00e9, caract\u00e9ris\u00e9e par l\u2019absence d\u2019obligations li\u00e9es \u00e0 l\u2019horaire et au lieu de travail et par des formes d\u2019organisation par phases, cycles et objectifs.<\/p>\n\n\n\n<p>Lorsqu\u2019il applique le travail agile dans son entreprise, l\u2019employeur doit tenir compte de la r\u00e9glementation en mati\u00e8re de protection des donn\u00e9es personnelles.<\/p>\n\n\n\n<p>Le R\u00e8glement (UE) 2016\/679 en mati\u00e8re de protection des donn\u00e9es personnelles (\u00ab RGPD \u00bb) a introduit le principe dit \u00abde responsabilisation\u00bb, c\u2019est-\u00e0-dire l\u2019adoption, par le Titulaire du traitement (dans notre cas l\u2019employeur), de comportements proactifs et de nature \u00e0 d\u00e9montrer l\u2019adoption concr\u00e8te de mesures finalis\u00e9es \u00e0 garantir l\u2019application du RGPD. En substance, l\u2019employeur est tenu de d\u00e9terminer et de g\u00e9rer les risques relatifs aux traitements effectu\u00e9s, dans le respect du principe de protection des donn\u00e9es, d\u00e8s la conception de chaque traitement (\u00ab by design \u00bb) et de protection des donn\u00e9es&nbsp; par d\u00e9faut (\u00ab by default \u00bb).<\/p>\n\n\n\n<p>Cela signifie que, dans le travail agile, l\u2019employeur doit effectuer une analyse des risques appropri\u00e9e et, si n\u00e9cessaire, une \u00e9valuation d\u2019impact, de fa\u00e7on \u00e0 analyser tous les risques existants et potentiels et de fa\u00e7on \u00e0 d\u00e9terminer les mesures de s\u00e9curit\u00e9, techniques et d\u2019organisation, propres \u00e0 garantir la s\u00e9curit\u00e9 et la protection des donn\u00e9es. Dans cette optique, l\u2019employeur doit adopter des R\u00e8glements, des Politiques ou des Lignes Directrices indiquant les comportements que les travailleurs agiles doivent suivre afin de garantir la confidentialit\u00e9, l\u2019int\u00e9grit\u00e9 et la disponibilit\u00e9 des donn\u00e9es trait\u00e9es dans l\u2019exercice de leurs fonctions.<\/p>\n\n\n\n<p>L\u2019employeur doit aussi v\u00e9rifier que le contr\u00f4le \u00e0 distance ne soit pas intrusif, en violation de l\u2019art. n\u00b0&nbsp;4 de la loi n\u00b0 300\/1970. Cela comporte un examen d\u00e9taill\u00e9 des syst\u00e8mes permettant un contr\u00f4le continu de l\u2019utilisation des instruments de travail et du r\u00e9seau de l\u2019entreprise de la part des salari\u00e9s.<\/p>\n\n\n\n<p>C\u2019est justement pour cela que le travailleur agile doit \u00eatre inform\u00e9 de fa\u00e7on d\u00e9taill\u00e9e sur les modalit\u00e9s selon lesquelles l\u2019employeur exerce son pouvoir de contr\u00f4le et sur les comportements passibles d\u2019une \u00e9ventuelle sanction disciplinaire.<\/p>\n\n\n\n<p>Mais pas seulement.
