{"id":28199,"date":"2021-03-31T12:20:13","date_gmt":"2021-03-31T10:20:13","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/cour-de-justice-de-lunion-europeenne-jobs-acts-et-licenciement-collectif\/"},"modified":"2026-04-08T14:44:32","modified_gmt":"2026-04-08T12:44:32","slug":"cour-de-justice-de-lunion-europeenne-jobs-acts-et-licenciement-collectif","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/cour-de-justice-de-lunion-europeenne-jobs-acts-et-licenciement-collectif\/","title":{"rendered":"Cour de Justice de l\u2019Union europ\u00e9enne : Jobs Acts et licenciement collectif"},"content":{"rendered":"\n<p>La Cour de Justice de l\u2019Union europ\u00e9enne (CJUE), par un arr\u00eat du 17 mars 2021 (affaire C-652\/2019), s\u2019est exprim\u00e9e sur les questions pr\u00e9judicielles pos\u00e9es par le Tribunal de Milan le 5 ao\u00fbt 2019 quant \u00e0 la validit\u00e9 des dispositions sur les licenciements collectifs contenues dans le Jobs Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les faits<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>L\u2019affaire concerne une salari\u00e9e embauch\u00e9e avec un contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e avant l\u2019entr\u00e9e en vigueur du Jobs Act, transform\u00e9 en contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e \u00e0 fin mars 2015, puis licenci\u00e9e en 2017 dans le cadre d\u2019une proc\u00e9dure de licenciement collectif.<\/p>\n\n\n\n<p>Les salari\u00e9s concern\u00e9s par la proc\u00e9dure en question, dont la salari\u00e9e susmentionn\u00e9e, saisissaient le Tribunal de Milan, qui constatait l\u2019irr\u00e9gularit\u00e9 des licenciements attaqu\u00e9s pour violation des crit\u00e8res de choix. Le Tribunal ne reconnaissait \u00e0 la salari\u00e9e &#8211; contrairement \u00e0 ses coll\u00e8gues qui avaient \u00e9t\u00e9 r\u00e9int\u00e9gr\u00e9s en ce qu\u2019ils avaient \u00e9t\u00e9 embauch\u00e9s avant l\u2019entr\u00e9e en vigueur du d\u00e9cret l\u00e9gislatif n\u00b0 23\/20215 (le Jobs Act), \u00e0 savoir avant le 7 mars 2015 &#8211; qu\u2019une indemnit\u00e9 \u00e9conomique.<\/p>\n\n\n\n<p>Le Tribunal, apr\u00e8s avoir constat\u00e9 l\u2019existence de deux r\u00e9gimes de sanction diff\u00e9rents en cas de licenciement collectif abusif suite \u00e0 l\u2019introduction du contrat de travail \u00ab&nbsp;a tutele crescenti&nbsp;\u00bb (offrant une protection croissante), s\u2019est adress\u00e9 \u00e0 la Cour de Strasbourg pour savoir si une telle diff\u00e9rence de traitement n\u2019est pas contraire au droit de l\u2019Union.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La d\u00e9cision de la CJUE<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>La Cour de Justice a reconnu la conformit\u00e9 du d\u00e9cret l\u00e9gislatif n\u00b0 23\/2015 au droit de l\u2019Union, en pr\u00e9cisant <strong>que le r\u00e9gime qui ne pr\u00e9voit qu\u2019une indemnit\u00e9 (au lieu de la r\u00e9int\u00e9gration) pour le salari\u00e9 embauch\u00e9 avec un contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e avant le 7 mars 2015, et transform\u00e9 ult\u00e9rieurement, n\u2019est pas discriminatoire<\/strong>.
