Concernant la l\u00e9galit\u00e9 d\u2019une telle mesure, estimez-vous qu\u2019une interdiction si \u00e9tendue et intrusive soit possible ?<\/em><\/h5>\n\n\n\n<p>Les sp\u00e9cialistes du secteur avaient d\u00e8s le d\u00e9but \u00e9mis des doutes quant \u00e0 la l\u00e9galit\u00e9 de cette mesure, en raison de l\u2019opposition claire de cette interdiction avec le droit constitutionnel de libert\u00e9 d\u2019initiative \u00e9conomique ; ces doutes ont certainement \u00e9t\u00e9 aliment\u00e9s par les continuelles prorogations de l\u2019interdiction qui, introduite initialement pour 3 mois, existe d\u00e9sormais depuis plus d\u2019un an. L\u2019\u00e9valuation sur la l\u00e9galit\u00e9 d\u00e9pend du poids des diff\u00e9rents int\u00e9r\u00eats et valeurs en jeu, qui sont tous de caract\u00e8re constitutionnel : d\u2019un c\u00f4t\u00e9, le droit \u00e0 la sant\u00e9 (individuelle et collective) et au travail, de l\u2019autre, celui de la libert\u00e9 d\u2019entreprise. Des critiques aux restrictions ont commenc\u00e9 \u00e0 \u00e9merger dans des juridictions semblables \u00e0 la n\u00f4tre.<\/p>\n\n\n\n<p>En Espagne, par exemple, face \u00e0 un cadre r\u00e9glementaire de crise sanitaire analogue au n\u00f4tre, le Tribunal de Barcelone n\u2019a pas appliqu\u00e9 l\u2019interdiction de licenciement et a consid\u00e9r\u00e9 comme l\u00e9gitime un licenciement pour raisons \u00e9conomiques, consid\u00e9rant l\u2019interdiction comme \u00e9tant contraire aussi bien \u00e0 la constitution qu\u2019au droit communautaire, qui en effet d\u00e9fend la libert\u00e9 d\u2019entreprise comme un des droits fondamentaux de l\u2019Union.<\/p>\n\n\n\n<p>Pour revenir \u00e0 nous, d\u2019autres prorogations de l\u2019interdiction de licenciement en vigueur en Italie, semble-t-il certaines, devront \u00e0 terme r\u00e9duire leur p\u00e9rim\u00e8tre d\u2019action, en tenant compte enfin des diff\u00e9rents int\u00e9r\u00eats oppos\u00e9s, en assouplissant les restrictions en vue d\u2019un retour (tout au moins en partie) \u00e0 des formes de flexibilit\u00e9 dans la gestion du personnel par les entreprises.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><em>L\u2019interdiction des licenciements est au centre d\u2019un bras de fer entre les entreprises, qui en invoquent la lev\u00e9e, et les partenaires sociaux, qui en demandent l\u2019extension. Pouvez-vous nous expliquer ce qui se passera si l\u2019interdiction \u00e9tait lev\u00e9e ou si elle \u00e9tait confirm\u00e9e ?<\/em><\/h5>\n\n\n\n<p>Il est clair que des prorogations ult\u00e9rieures de l\u2019interdiction risqueraient seulement de renvoyer un probl\u00e8me qui, t\u00f4t ou tard, devra in\u00e9vitablement \u00eatre affront\u00e9, \u00e9tant donn\u00e9 que le prolongement de la crise sanitaire a entra\u00een\u00e9 \u00e0 tous les \u00e9gards la plus profonde crise \u00e9conomique depuis la guerre, destin\u00e9e \u00e0 avoir des cons\u00e9quences diffuses au cours des prochaines ann\u00e9es.<\/p>\n\n\n\n<p>Certainement, en l\u2019absence de prorogation de l\u2019interdiction, les entreprises qui jusqu\u2019\u00e0 pr\u00e9sent ont \u00e9t\u00e9 contraintes de maintenir les emplois prendront les mesures qui ont \u00e9t\u00e9 renvoy\u00e9es dans le temps, li\u00e9es dans de nombreux cas \u00e0 des motifs de licenciement \u00e9trangers \u00e0 la crise sanitaire et m\u00eame ant\u00e9rieurs \u00e0 celle-ci. Cela aboutira forc\u00e9ment \u00e0 une reprise du contentieux en mati\u00e8re de licenciement, gel\u00e9 depuis d\u00e9sormais un an.
