lorsque le salari\u00e9 licenci\u00e9 pour un motif objectif justifi\u00e9 n&rsquo;\u00e9tait disponible \u00e0 la mutation que dans certaines zones &#8211; doit prouver, pour ne pas encourir la violation de l&rsquo;obligation du dit rep\u00eachage, seulement l&rsquo;impossibilit\u00e9 de le reclasser dans les sites de l&rsquo;entreprise situ\u00e9s dans ces zones.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les faits<\/strong><\/h2>\n\n\n\n<p>Une salari\u00e9e a contest\u00e9 en justice son licenciement pour motif justifi\u00e9, qui lui a \u00e9t\u00e9 notifi\u00e9 \u00e0 la suite de la fermeture de l&rsquo;unit\u00e9 locale o\u00f9 elle \u00e9tait employ\u00e9e en tant que <em>store manager<\/em>.<\/p>\n\n\n\n<p>La Cour d&rsquo;appel comp\u00e9tente, en r\u00e9formant le jugement de premi\u00e8re instance, a rejet\u00e9 le recours pr\u00e9sent\u00e9 par la salari\u00e9e, invoquant la non-violation de l&rsquo;obligation de rep\u00eachage, compte tenu de la disponibilit\u00e9 de cette derni\u00e8re \u00e0 \u00eatre reclass\u00e9e uniquement dans l&rsquo;un des sites de l&#8217;employeur situ\u00e9s en Campanie ou dans le Bas-Latium.<\/p>\n\n\n\n<p>La salari\u00e9e s\u2019est pourvue en cassation contre cette d\u00e9cision des juges.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La d\u00e9cision de la Cour de Cassation<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>La Cour de cassation a confirm\u00e9 le jugement du tribunal de district et, reprenant certaines de ses propres lignes directrices \u00e9tablies, a d\u00e9clar\u00e9 \u00e0 titre pr\u00e9liminaire que : \u00ab<em> en mati\u00e8re de licenciement pour motif objectif justifi\u00e9,<strong> il appartient \u00e0 l&#8217;employeur d&rsquo;all\u00e9guer et de prouver l&rsquo;impossibilit\u00e9 de rep\u00eachage du salari\u00e9 licenci\u00e9<\/strong>, comme condition de l\u00e9gitimit\u00e9 de la r\u00e9siliation de l&#8217;employeur,<strong> sans que le salari\u00e9 ait la charge d&rsquo;all\u00e9guer les postes assignables, puisque, du point de vue proc\u00e9dural, un \u00e9cart entre les charges pr\u00e9cit\u00e9es n\u2019est pas configurable \u00bb<\/strong><\/em> (cf. arr\u00eat n\u00b0 5592\/2016 ; arr\u00eat &nbsp;n\u00b0 12101\/2016 et arr\u00eat n\u00b0 160\/2017).<\/p>\n\n\n\n<p>Et pour la Cour de cassation, l&#8217;employeur s&rsquo;acquitte de cette charge lorsqu&rsquo;il peut <strong>d\u00e9montrer qu&rsquo;il n&rsquo;y a pas de possibilit\u00e9 de reclasser le salari\u00e9 licenci\u00e9 dans un site situ\u00e9 \u00e0 l\u2019int\u00e9rieur du territoire o\u00f9 celui-ci s&rsquo;est dit pr\u00eat \u00e0 se d\u00e9placer.<\/strong> En effet, bien que le salari\u00e9 n&rsquo;ait aucune obligation d\u2019all\u00e9gation, d\u00e8s lors qu&rsquo;il d\u00e9finit &#8211;
