{"id":28230,"date":"2021-05-31T08:14:36","date_gmt":"2021-05-31T06:14:36","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/licenciement-collectif-possibilite-de-limiter-la-procedure-a-certains-sieges\/"},"modified":"2026-04-08T14:41:45","modified_gmt":"2026-04-08T12:41:45","slug":"licenciement-collectif-possibilite-de-limiter-la-procedure-a-certains-sieges","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/case-law-fr\/licenciement-collectif-possibilite-de-limiter-la-procedure-a-certains-sieges\/","title":{"rendered":"Licenciement collectif : possibilit\u00e9 de limiter la proc\u00e9dure \u00e0 certains si\u00e8ges"},"content":{"rendered":"\n<p>La Cour de cassation, par son arr\u00eat du 6 mai 2021, n\u00b0 12040, a d\u00e9clar\u00e9 qu\u2019il est l\u00e9gitime, dans le cadre d\u2019une proc\u00e9dure de licenciement collectif, de limiter le p\u00e9rim\u00e8tre d\u2019intervention aux unit\u00e9s productives objet de la r\u00e9organisation, au lieu de toucher l\u2019ensemble du personnel de l\u2019entreprise.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Les faits<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>Une soci\u00e9t\u00e9 avait ouvert, en d\u00e9cembre 2016, une proc\u00e9dure de licenciement collectif, en limitant le projet de redimensionnement \u00e0 seulement deux unit\u00e9s de production et, par cons\u00e9quent, sans toucher, dans l\u2019application des crit\u00e8res de choix des travailleurs \u00e0 licencier, l\u2019ensemble du personnel de l\u2019entreprise.<\/p>\n\n\n\n<p>Dans la communication d\u2019ouverture de la proc\u00e9dure, on expliquait que ce choix \u00e9tait justifi\u00e9, tout d\u2019abord, par la distance g\u00e9ographique de ces unit\u00e9s de production par rapport aux autres sites de l\u2019entreprise. Ceci rendait anti-\u00e9conomique, sur la base de ses exigences d\u2019organisation, un \u00e9ventuel transfert collectif des salari\u00e9s \u00e0 la place du licenciement effectu\u00e9. En second lieu, ce choix \u00e9tait li\u00e9 au caract\u00e8re non fongible des fonctions des salari\u00e9s pr\u00e9pos\u00e9s aux deux unit\u00e9s concern\u00e9es, par rapport aux travailleurs employ\u00e9s dans d\u2019autres si\u00e8ges.<\/p>\n\n\n\n<p>Quelques-uns des travailleurs licenci\u00e9s ont saisi l\u2019autorit\u00e9 judiciaire afin d\u2019\u00e9tendre le nombre des travailleurs touch\u00e9s par le licenciement \u00e0 l\u2019ensemble du personnel de l\u2019entreprise. Suite \u00e0 l\u2019arr\u00eat de la Cour d\u2019Appel territorialement comp\u00e9tente \u2013 qui avait d\u00e9clar\u00e9 la conformit\u00e9 de la communication d\u2019ouverture de la proc\u00e9dure aux conditions requises par l\u2019art. 4, troisi\u00e8me alin\u00e9a, de la&nbsp;Loi n\u00b0 223\/1991 &#8211;&nbsp; les travailleurs se sont pourvus en Cassation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La d\u00e9cision de la Cour de Cassation<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>La Cour de Cassation, partageant les arguments des juges du fond, a tout d\u2019abord confirm\u00e9 que (i) <strong>la cessation de l\u2019activit\u00e9 est un choix du chef d\u2019entreprise<\/strong> et constitue <strong>un exercice inali\u00e9nable de la libert\u00e9 d\u2019entreprise<\/strong> garantie par l\u2019article 41 de la Constitution et que (iii) la <strong>proc\u00e9dure de licenciement collectif a pour seule fonction de permettre le contr\u00f4le par les syndicats sur l\u2019efficacit\u00e9 de ce choix.<\/strong> Et le contr\u00f4le judiciaire ne porte pas sur les motifs de la r\u00e9duction du personnel mais seulement sur le caract\u00e8re correct de la proc\u00e9dure.<\/p>\n\n\n\n<p>Ceci \u00e9tant pr\u00e9cis\u00e9, la Cour de Cassation affronte la question centrale de l\u2019affaire, pour arriver \u00e0 une conclusion conforme \u00e0 son orientation consolid\u00e9e, selon laquelle la d\u00e9limitation est l\u00e9gitime quand <strong>le projet de restructuration<\/strong> se r\u00e9f\u00e8re <strong>exclusivement \u00e0 une ou plusieurs unit\u00e9s de production,<\/strong> \u00e0 la condition que <strong>les raisons technico-productives et d\u2019organisation<\/strong> de la limitation soient <strong>\u00e9nonc\u00e9es de fa\u00e7on ad\u00e9quate dans la communication d\u2019ouverture de la proc\u00e9dure, \u00e9galement sur la base du caract\u00e8re fongible ou non des fonctions exerc\u00e9es par les travailleurs des si\u00e8ges concern\u00e9s<\/strong>, et qu\u2019elles soient <strong>coh\u00e9rentes avec les raisons indiqu\u00e9es comme fondement de la r\u00e9duction du personnel.<\/strong> En l\u2019esp\u00e8ce, selon la Cour, le caract\u00e8re non fongible des fonctions r\u00e9side dans la particularit\u00e9 de chaque site de production, en raison des march\u00e9s qui y sont trait\u00e9s, laquelle aurait rendu impraticable, \u00e0 divers niveaux, le transfert d\u2019un si\u00e8ge \u00e0 l\u2019autre.<\/p>\n\n\n\n<p class=\"has-text-align-center\">\u25ca\u25ca\u25ca\u25ca<\/p>\n\n\n\n<p>Par cet arr\u00eat, la Cour de Cassation admet, en substance, le recours aux exigences techniques, d\u2019organisation et de production comme unique crit\u00e8re de choix aux fins de la d\u00e9termination du personnel \u00e0 licencier dans le cadre d\u2019une proc\u00e9dure de licenciement collectif.
