Dans le cas en question, la soci\u00e9t\u00e9 avait d\u00e9cid\u00e9 de supprimer le poste d&#8217;employ\u00e9e administrative occup\u00e9 par la salari\u00e9e suite \u00e0 l&rsquo;externalisation des activit\u00e9s administratives et \u00e0 l&rsquo;adoption de syst\u00e8mes de gestion automatis\u00e9s.<\/p>\n\n\n\n<p>A bien y regarder, la Cour d&rsquo;appel de Florence, dans son jugement de plainte en vertu de l&rsquo;art. 58, Loi 92\/2012, avait confirm\u00e9 la d\u00e9cision du juge de premi\u00e8re instance qui, lors de la phase sommaire, avait constat\u00e9 qu&rsquo;il n&rsquo;y avait pas de motif objectif justifi\u00e9 de licenciement, \u00e9tant donn\u00e9 que les t\u00e2ches effectu\u00e9es par la salari\u00e9e avaient \u00e9t\u00e9, depuis le lendemain du licenciement, confi\u00e9es \u00e0 une coll\u00e8gue qui, au-del\u00e0 de la classification formelle, \u00e9tait une \u00ab employ\u00e9e administrative ordinaire pleinement int\u00e9gr\u00e9e dans l&rsquo;unit\u00e9 de production \u00bb de la soci\u00e9t\u00e9.<\/p>\n\n\n\n<p>En outre, il est apparu au cours de l&rsquo;enqu\u00eate judiciaire que la d\u00e9cision de licencier la salari\u00e9e \u00e9tait intervenue \u00e0 la suite de son refus d&rsquo;accepter &#8211; dans le cadre d&rsquo;un accord novatoire propos\u00e9 par la soci\u00e9t\u00e9 &#8211; un changement de son niveau d&rsquo;encadrement et la r\u00e9duction cons\u00e9quente de son salaire portant uniquement sur le super-minimum.<\/p>\n\n\n\n<p>Selon les juges, l&rsquo;appr\u00e9ciation de l&rsquo;existence d&rsquo;un motif de r\u00e9torsion pour le licenciement a donc \u00e9t\u00e9 prise par la Cour comme le r\u00e9sultat d&rsquo;un raisonnement sens\u00e9 et apte \u00e0 mettre en \u00e9vidence une corr\u00e9lation entre le rejet de la proposition novatoire et le licenciement, en constatant que la pr\u00e9tendue externalisation n&rsquo;avait pas fait dispara\u00eetre la n\u00e9cessit\u00e9 du poste de travail occup\u00e9e par la salari\u00e9e, \u00e9tant donn\u00e9 que les t\u00e2ches de la salari\u00e9e, d\u00e8s le lendemain du licenciement, avaient \u00e9t\u00e9 confi\u00e9es \u00e0 une autre employ\u00e9e.<\/p>\n\n\n\n<p>Continuez \u00e0 lire la version int\u00e9grale publi\u00e9e sur&nbsp;<a href=\"https:\/\/ntplusdiritto.ilsole24ore.com\/art\/in-mancanza-motivo-legittimo-e-ritorsivo-licenziamento-lavoratore-che-rifiuta-accordo-novativo-AEaIcnN\">Norme &amp;
