{"id":28302,"date":"2021-10-25T14:23:00","date_gmt":"2021-10-25T12:23:00","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/le-travail-a-distance-et-le-retour-en-entreprise-considerations-dapres-crise\/"},"modified":"2026-02-16T16:34:17","modified_gmt":"2026-02-16T15:34:17","slug":"le-travail-a-distance-et-le-retour-en-entreprise-considerations-dapres-crise","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/news\/publications-2-fr\/le-travail-a-distance-et-le-retour-en-entreprise-considerations-dapres-crise\/","title":{"rendered":"Le travail \u00e0 distance et le retour en entreprise : consid\u00e9rations d\u2019apr\u00e8s-crise (Il Quotidiano del lavoro de Il Sole 24 Ore, 25 octobre 2021 \u2013 Vittorio De Luca)"},"content":{"rendered":"\n<p>Le travail \u00e0 distance a augment\u00e9 de mani\u00e8re exponentielle en raison de l&rsquo;urgence sanitaire Covid-19 qui a d\u00e9but\u00e9 en 2020.<\/p>\n\n\n\n<p>Les avantages et le potentiel de ce mode particulier d&rsquo;ex\u00e9cution de la prestation professionnelle, exp\u00e9riment\u00e9s de force \u00e0 une \u00e9chelle de masse lors de la pand\u00e9mie, ont orient\u00e9 de nombreuses entreprises vers une nouvelle organisation \u00ab hybride \u00bb combinant le travail en pr\u00e9sentiel et le travail \u00e0 distance.<\/p>\n\n\n\n<p>En fait, de nombreuses entreprises ont mis en place des formes de travail flexibles qui laissent aux salari\u00e9s le choix de travailler en pr\u00e9sentiel ou \u00e0 \u00ab distance \u00bb, rendant ainsi les fronti\u00e8res spatiales et temporelles du travail salari\u00e9 beaucoup plus fluides.<\/p>\n\n\n\n<p>Toutefois, compte tenu du cadre r\u00e9glementaire complexe li\u00e9 \u00e0 la crise, il est primordial de veiller \u00e0 ce que le travail \u00e0 distance soit pratiqu\u00e9 correctement dans la p\u00e9riode post-pand\u00e9mique ; cela est possible, tout d&rsquo;abord, en comprenant que travailler en mode \u00ab t\u00e9l\u00e9travail \u00bb ne signifie pas travailler \u00ab \u00e0 domicile \u00bb. Le travail \u00e0 distance, r\u00e9gi par le Chapitre II de la Loi n\u00b0 81\/2017, repr\u00e9sente une nouvelle m\u00e9thode flexible particuli\u00e8re d\u2019organisation du travail subordonn\u00e9, qui ne r\u00e9pond pas aux contraintes de lieu et de dur\u00e9e du travail, et qui est arr\u00eat\u00e9e par accord entre les parties. Le salari\u00e9, conform\u00e9ment \u00e0 l\u2019art. 18, alin\u00e9a 1 de la loi pr\u00e9cit\u00e9e, exerce son activit\u00e9 en partie \u00e0 l&rsquo;int\u00e9rieur des locaux de l&rsquo;entreprise et en partie \u00e0 l&rsquo;ext\u00e9rieur de ceux-ci, sans un lieu fixe.<\/p>\n\n\n\n<p>La r\u00e9alisation d&rsquo;activit\u00e9s en mode \u00e0 distance n\u00e9cessite donc la conclusion d&rsquo;un accord &#8211; \u00e0 dur\u00e9e d\u00e9termin\u00e9e ou ind\u00e9termin\u00e9e &#8211; entre l&#8217;employeur et le salari\u00e9, visant \u00e0 r\u00e9glementer des aspects importants, tels que (i) les formes d&rsquo;exercice du pouvoir de direction et de contr\u00f4le de l&#8217;employeur ; (ii) les p\u00e9riodes de repos du salari\u00e9 et les mesures techniques et organisationnelles n\u00e9cessaires pour garantir le droit du salari\u00e9 \u00e0 se d\u00e9connecter des instruments technologiques de travail ; (iii) tout comportement susceptible d&rsquo;\u00eatre sanctionn\u00e9 au niveau disciplinaire et, enfin, (iv) tout droit \u00e0 l&rsquo;apprentissage.<\/p>\n\n\n\n<p>On le sait, la l\u00e9gislation adopt\u00e9e durant la crise de l&rsquo;ann\u00e9e derni\u00e8re a conduit \u00e0 une d\u00e9rogation partielle aux r\u00e8gles ordinaires, avec l&rsquo;introduction d&rsquo;un mode \u00ab simplifi\u00e9 \u00bb d&rsquo;utilisation du travail \u00e0 distance. Selon ce mode, le travail \u00e0 distance peut \u00e9galement \u00eatre mis en \u0153uvre en l&rsquo;absence d&rsquo;accord individuel avec les salari\u00e9s, en envoyant une communication par voie d\u00e9mat\u00e9rialis\u00e9e au Minist\u00e8re du travail et de la politique sociale en pr\u00e9cisant les noms des salari\u00e9s concern\u00e9s et la date de fin de la prestation en mode \u00e0 distance.<\/p>\n\n\n\n<p>Par ailleurs, la r\u00e9glementation pr\u00e9voit que les obligations concernant la note d\u2019information sur les risques pour la sant\u00e9 et la s\u00e9curit\u00e9 au travail pr\u00e9vue par l\u2019art. 22 de la loi n\u00b0 81\/2017 peuvent \u00eatre acquitt\u00e9es par voie d\u00e9mat\u00e9rialis\u00e9e. Actuellement, la possibilit\u00e9 pour les employeurs du secteur priv\u00e9 de recourir au travail \u00e0 distance de fa\u00e7on simplifi\u00e9e est fix\u00e9e jusqu\u2019au 31 d\u00e9cembre 2021 par la loi n\u00b0 87\/2021 de conversion en loi du D\u00e9cret l\u00e9g, n\u00b0 52\/2021 (dit D\u00e9cret <em>Riaperture<\/em>).<\/p>\n\n\n\n<p>\u00c0 cet \u00e9gard, il convient de noter que la discipline \u00ab de crise \u00bb du travail \u00e0 distance a donn\u00e9 lieu \u00e0 une d\u00e9rogation &#8211; \u00e9galement proche de l&rsquo;expiration &#8211; limit\u00e9e \u00e0 l&rsquo;accord individuel entre les parties, n&rsquo;impliquant toutefois pas la disparition de la n\u00e9cessit\u00e9 de r\u00e9glementer et, donc, de garantir toute une s\u00e9rie d&rsquo;aspects qui trouvent leur place naturelle de discipline dans l&rsquo;accord, \u00e0 savoir la \u00ab prestation de travail \u00bb, les \u00ab formes d&rsquo;exercice du pouvoir ex\u00e9cutif de l&#8217;employeur \u00bb, les \u00ab outils utilis\u00e9s par le salari\u00e9 \u00bb ; le \u00ab temps de repos du salari\u00e9 \u00bb ; \u00ab les mesures techniques et organisationnelles n\u00e9cessaires pour assurer la d\u00e9connexion du salari\u00e9 des \u00e9quipements technologiques utilis\u00e9s sur le lieu de travail \u00bb ; \u00ab le droit \u00e0 la formation permanente \u00bb ; \u00ab l&rsquo;exercice du pouvoir de contr\u00f4le de l&#8217;employeur \u00bb ; \u00ab les comportements li\u00e9s \u00e0 la prestation de travail&#8230;. qui donnent lieu \u00e0 l&rsquo;application de sanctions disciplinaires \u00bb (art. 18, 19, 20 et 21 de la Loi n\u00b0 81\/2017).<\/p>\n\n\n\n<p>Continuez \u00e0 lire la version int\u00e9grale publi\u00e9e sur&nbsp;<a href=\"https:\/\/quotidianolavoro.ilsole24ore.com\/art\/rapporto-lavoro\/2021-10-22\/il-lavoro-agile-e-rientro-azienda-considerazioni-post-emergenza-150844.php?uuid=AEXlynr\"><strong><em>Il Quotidiano del Lavoro<\/em><\/strong><\/a>&nbsp;de&nbsp;<strong>Il Sole 24 Ore<\/strong>.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le travail \u00e0 distance a augment\u00e9 de mani\u00e8re exponentielle en raison de l&rsquo;urgence sanitaire Covid-19 qui a d\u00e9but\u00e9 en 2020.
