Selon lui, la soci\u00e9t\u00e9 employeur aurait d\u00fb l\u2019avertir de l\u2019\u00e9ch\u00e9ance imminente de la p\u00e9riode de cong\u00e9.<\/p>\n\n\n\n<p>Le Tribunal saisi par le travailleur avait d\u00e9clar\u00e9 le licenciement injustifi\u00e9, puis la Cour d\u2019Appel avait infirm\u00e9 le jugement de premier degr\u00e9. Le travailleur succombant a donc saisi la Cour de Cassation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La d\u00e9cision de la Cour de Cassation<\/strong><strong><\/strong><\/h2>\n\n\n\n<p>La Cour de Cassation, confirmant d\u00e9finitivement le bien fond\u00e9 du licenciement, a pr\u00e9cis\u00e9 que, <strong>en l\u2019absence d e toute obligation pr\u00e9vue par la convention collective, l\u2019entreprise n\u2019est pas tenue d\u2019avertir pr\u00e9alablement le travailleur de l\u2019\u00e9ch\u00e9ance imminente de la p\u00e9riode de cong\u00e9 maladie,<\/strong> afin de permettre \u00e0 celui-ci d\u2019exercer \u00e9ventuellement sa facult\u00e9 de demander rapidement sa mise en disponibilit\u00e9.<\/p>\n\n\n\n<p>Selon la Cour de Cassation, le licenciement en objet est motiv\u00e9 par l\u2019absence pour maladie objectivement prolong\u00e9e, d\u00e9passant la dur\u00e9e maximum pr\u00e9vue par la Convention Collective Nationale du Travail du secteur et, donc, par l\u2019impossibilit\u00e9 de fournir la prestation de travail. Ce licenciement n\u2019a pas une nature disciplinaire et, donc, la contestation pr\u00e9alable des absences n\u2019est pas n\u00e9cessaire.
