{"id":28339,"date":"2022-03-02T16:11:28","date_gmt":"2022-03-02T15:11:28","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/le-licenciement-du-cadre-dirigeant-qui-envoie-un-courriel-agressif-a-la-haute-direction-de-lentreprise-est-justifie\/"},"modified":"2026-02-16T16:34:36","modified_gmt":"2026-02-16T15:34:36","slug":"le-licenciement-du-cadre-dirigeant-qui-envoie-un-courriel-agressif-a-la-haute-direction-de-lentreprise-est-justifie","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/case-law-fr\/le-licenciement-du-cadre-dirigeant-qui-envoie-un-courriel-agressif-a-la-haute-direction-de-lentreprise-est-justifie\/","title":{"rendered":"Le licenciement du cadre dirigeant qui envoie un courriel agressif \u00e0 la haute direction de l\u2019entreprise est justifi\u00e9"},"content":{"rendered":"\n<p>La Cour de cassation, par son ordonnance n\u00b0 2246 du 26 janvier 2022, a statu\u00e9 que le cadre dirigeant qui adresse \u00e0 sa direction un courriel agressif fait preuve d\u2019une conduite susceptible de compromettre le rapport de confiance le liant \u00e0 son employeur, m\u00eame s\u2019il ne commet pas de manquement formel \u00e0 ses obligations professionnelles.<\/p>\n\n\n\n<p><strong>Faits<\/strong><strong><\/strong><\/p>\n\n\n\n<p>Un cadre dirigeant \u00e9tait licenci\u00e9 pour faute apr\u00e8s avoir adress\u00e9 \u00e0 sa direction un courriel das lequel on pouvait lire <em>\u00ab vous avez trahi ma confiance et ma bonne foi, je ne sais pas combien de temps je pourrai continuer \u00e0 supporter votre comportement qui est pour moi inqualifiable&nbsp;\u00bb<\/em>.<\/p>\n\n\n\n<p>Le cadre dirigeant licenci\u00e9 assignait son ancien employeur en justice (i) en invoquant le fait que son courriel avait \u00e9t\u00e9 provoqu\u00e9 par un unique \u00e9pisode qui avait d\u00e9clench\u00e9 chez lui une forte r\u00e9action psychologique et (ii) en demandant de la condamner au paiement de l\u2019indemnit\u00e9 compensatrice de pr\u00e9avis et de l\u2019indemnit\u00e9 suppl\u00e9mentaire, conform\u00e9ment \u00e0 la convention collective des cadres dirigeants de l\u2019industrie, ainsi qu\u2019au paiement de dommages-int\u00e9r\u00eats pour r\u00e9trogradation et harc\u00e8lement moral.<\/p>\n\n\n\n<p>Le Tribunal accueillait partiellement la requ\u00eate et statuait que le licenciement, m\u00eame s\u2019il ne pouvait se fonder sur une faute grave \u00e9tait en tout \u00e9tat de cause \u00ab <em>justifi\u00e9&nbsp;\u00bb<\/em> par la convention collective de branche en ce qu\u2019il n\u2019\u00e9tait ni abusif ni arbitraire&nbsp;: d\u2019o\u00f9 la reconnaissance au cadre dirigeant de la seule indemnit\u00e9 compensatrice de pr\u00e9avis et le rejet des autres demandes.<\/p>\n\n\n\n<p>La Cour d\u2019Appel confirmait la d\u00e9cision du juge de premi\u00e8re instance, en soulignant que \u00ab&nbsp;<em>les r\u00e9flexions \u00e0 l\u2019employeur, d\u2019apr\u00e8s ce que l\u2019on peut lire dans le courriel litigieux (\u2026), m\u00eame si elles ne relevaient pas de la faute grave, permettaient de retenir, \u00e0 la lumi\u00e8re des fonctions de direction et de l\u2019importance en d\u00e9coulant de la relation de confiance, la notion de justification exig\u00e9e par la convention collective, l\u2019indemnit\u00e9 suppl\u00e9mentaire n\u2019\u00e9tant donc pas due&nbsp;\u00bb<\/em>.<\/p>\n\n\n\n<p>Le cadre dirigeant se pourvoyait alors en cassation.<\/p>\n\n\n\n<p><strong>La d\u00e9cision de la Cour de Cassation<\/strong><strong><\/strong><\/p>\n\n\n\n<p>La Cour charg\u00e9e de l\u2019affaire a en premier lieu observ\u00e9 que, de jurisprudence constante, \u00ab&nbsp;<strong><em>pour la justification&nbsp;\u00bb<\/em><\/strong> du licenciement il n\u2019est pas n\u00e9cessaire d\u2019effectuer une v\u00e9rification analytique des conditions sp\u00e9cifiques mais <strong>une \u00e9valuation globale excluant le caract\u00e8re arbitraire du licenciement suffit<\/strong>, en ce qu\u2019il est inflig\u00e9 en faisant r\u00e9f\u00e9rence \u00e0 des <strong>circonstances susceptibles de compromettre la relation de confiance le liant \u00e0 son employeur<\/strong>. On consid\u00e8re comme valable tout motif permettant de fonder le licenciement, de fa\u00e7on coh\u00e9rente et bas\u00e9e sur des raisons appr\u00e9ciables sous l\u2019angle du droit. En l\u2019esp\u00e8ce, le comportement du cadre dirigeant est retenu susceptible, au regard des principes de bonne foi et de loyaut\u00e9 contractuelle, de remettre en cause la relation de confiance avec l\u2019employeur, m\u00eame s\u2019il n\u2019y a pas de manquement aux obligations professionnelles.&nbsp;<\/p>\n\n\n\n<p>En l\u2019esp\u00e8ce, selon la Cour de cassation, le licenciement est justifi\u00e9 par l\u2019exigence pour le chef d\u2019entreprise&nbsp;de pouvoir compter pleinement&nbsp; sur le&nbsp;cadre dirigeant&nbsp;pour ex\u00e9cuter les directives qui lui sont imparties.<\/p>\n\n\n\n<p>\u00c0 la lumi\u00e8re de ce qui pr\u00e9c\u00e8de, la Cour de cassation a rejet\u00e9 le pourvoi du cadre dirigeant et l\u2019a condamn\u00e9 au d\u00e9pens.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de cassation, par son ordonnance n\u00b0 2246 du 26 janvier 2022, a statu\u00e9 que le cadre dirigeant qui adresse \u00e0 sa direction un courriel agressif fait preuve d\u2019une conduite susceptible de compromettre le rapport de confiance le liant \u00e0 son employeur, m\u00eame s\u2019il ne commet pas de manquement formel \u00e0 ses obligations professionnelles.
