{"id":28364,"date":"2022-04-12T07:38:15","date_gmt":"2022-04-12T05:38:15","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/refonte-de-la-reglementation-en-matiere-damortisseurs-sociaux-en-cours-de-contrat-de-travail\/"},"modified":"2026-04-07T11:31:34","modified_gmt":"2026-04-07T09:31:34","slug":"refonte-de-la-reglementation-en-matiere-damortisseurs-sociaux-en-cours-de-contrat-de-travail","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/news\/refonte-de-la-reglementation-en-matiere-damortisseurs-sociaux-en-cours-de-contrat-de-travail\/","title":{"rendered":"Refonte de la r\u00e9glementation en mati\u00e8re d\u2019amortisseurs sociaux en cours de contrat de travail"},"content":{"rendered":"\n<p>Le Minist\u00e8re du Travail, par la circulaire n\u00b0 6\/2022, a donn\u00e9 des indications sur l\u2019introduction des nouveaut\u00e9s apport\u00e9es par le d\u00e9cret-loi n\u00b0 4 du 27 janvier 2022 (appel\u00e9 D\u00e9cret \u00ab Sostegni ter \u00bb), concernant l\u2019acc\u00e8s aux compl\u00e9ments de salaire \u00e0 verser aux travailleurs en cours de contrat de travail.<\/p>\n\n\n\n<p>En mati\u00e8re de ch\u00f4mage partiel pour cessation d\u2019activit\u00e9, le Minist\u00e8re a pr\u00e9cis\u00e9 que les entreprises qui utilisent en totalit\u00e9 en 2022 la p\u00e9riode relative peuvent signer un accord de transition afin de b\u00e9n\u00e9ficier de 12 mois suppl\u00e9mentaires de ch\u00f4mage partiel. Pendant cette p\u00e9riode, l\u2019entreprise doit s\u2019engager \u00e0 g\u00e9rer les sureffectifs r\u00e9siduels au moyen d\u2019une politique de l\u2019emploi active.<\/p>\n\n\n\n<p>Le Minist\u00e8re traite, \u00e9galement, de la possibilit\u00e9 introduite par la Loi de finances 2022, pour les entreprises pouvant acc\u00e9der au ch\u00f4mage partiel extraordinaire (\u00ab CIGS \u00bb), d\u2019utiliser la cause de la \u00ab r\u00e9organisation \u00bb m\u00eame dans le cadre d\u2019un \u00ab processus de transition \u00bb. Selon la r\u00e9glementation, l\u2019entreprise doit r\u00e9diger un programme qui, selon les cas, pourra m\u00eame \u00eatre partag\u00e9 avec les R\u00e9gions concern\u00e9es ou avec le Minist\u00e8re du D\u00e9veloppement \u00c9conomique (\u00ab MISE \u00bb). Ce programme doit illustrer les investissements (sans obligations quantitatives) mis en place pour la r\u00e9alisation du processus de transition, en indiquant de fa\u00e7on pr\u00e9cise les mesures sp\u00e9cifiques prises en vue d\u2019une modernisation technologique et num\u00e9rique ou en vue du renouvellement et de la durabilit\u00e9 \u00e9cologique et \u00e9nerg\u00e9tique ou bien les mesures de s\u00e9curit\u00e9 extraordinaires.<\/p>\n\n\n\n<p>Sur ce point, le Minist\u00e8re a expliqu\u00e9 que les plans de r\u00e9organisation de l\u2019entreprise doivent \u00eatre assortis d\u2019interventions structur\u00e9es afin d\u2019affronter le manque d\u2019efficacit\u00e9 dans l\u2019organisation de la gestion ou de la production et d\u2019actions visant \u00e0 r\u00e9aliser dans l\u2019entreprise des transformations et des transitions num\u00e9riques, technologiques, \u00e9cologiques et \u00e9nerg\u00e9tiques.<\/p>\n\n\n\n<p>L\u2019accord de transition, pr\u00e9cise le Minist\u00e8re, vise \u00e0 favoriser les transitions en mati\u00e8re d\u2019emploi. Il est donc principalement destin\u00e9 aux travailleurs qui, suite aux actions d\u2019un programme d\u2019entreprise de r\u00e9organisation ou de redressement d\u00e9j\u00e0 conclu par l\u2019entreprise qui les emploie, ne peuvent pas encore \u00eatre r\u00e9employ\u00e9s et risquent donc d\u2019\u00eatre licenci\u00e9s.<\/p>\n\n\n\n<p>L\u2019entreprise qui demande cette mesure ne doit toutefois pas se trouver dans la condition de pouvoir acc\u00e9der \u00e0 des p\u00e9riodes suppl\u00e9mentaires d\u2019interventions extraordinaires durant le quinquennat mobile non encore \u00e9puis\u00e9. Pour obtenir cette aide au revenu, l\u2019entreprise doit (i) lancer une consultation syndicale, en indiquant les travailleurs en sureffectif auxquels la mesure s\u2019adresse et (ii) d\u00e9terminer avec la R\u00e9gion les actions de formation et de requalification en vue de la r\u00e9insertion et de l\u2019emploi ind\u00e9pendant des travailleurs.
