Les jours suivants, le travailleur a attaqu\u00e9 le licenciement qui lui avait \u00e9t\u00e9 inflig\u00e9 et a communiqu\u00e9, par courrier \u00e9lectronique certifi\u00e9, sa disponibilit\u00e9 imm\u00e9diate \u00e0 reprendre le travail.<\/p>\n\n\n\n<p>S\u2019\u00e9tant constitu\u00e9e en justice, la soci\u00e9t\u00e9 a excip\u00e9 l\u2019inexistence d\u2019un licenciement oral, en d\u00e9duisant que c\u2019\u00e9tait le travailleur qui s\u2019\u00e9tait \u00e9loign\u00e9 arbitrairement de son lieu de travail et qui par cons\u00e9quent s\u2019av\u00e9rait \u00eatre absent injustifi\u00e9. Cette absence n\u2019\u00e9tait pas contest\u00e9e au travailleur, eu \u00e9gard \u00e0 la renonciation de la soci\u00e9t\u00e9 \u00e0 exercer son pouvoir disciplinaire.<\/p>\n\n\n\n<p>Le Juge du fond, apr\u00e8s une instruction approfondie, a rejet\u00e9 la demande du travailleur, ce dernier n\u2019ayant pas prouv\u00e9 l\u2019existence du licenciement oral contest\u00e9.
