{"id":28382,"date":"2022-05-12T15:15:51","date_gmt":"2022-05-12T13:15:51","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/family-act-de-nouvelles-dispositions-a-venir-pour-la-conciliation-vie-privee-vie-professionnelle\/"},"modified":"2026-02-16T16:34:50","modified_gmt":"2026-02-16T15:34:50","slug":"family-act-de-nouvelles-dispositions-a-venir-pour-la-conciliation-vie-privee-vie-professionnelle","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/news\/family-act-de-nouvelles-dispositions-a-venir-pour-la-conciliation-vie-privee-vie-professionnelle\/","title":{"rendered":"Family\u00a0Act: de nouvelles dispositions \u00e0 venir pour la conciliation vie priv\u00e9e &#8211; vie professionnelle"},"content":{"rendered":"\n<p>La loi d\u2019habilitation n\u00b0 32 du 7 avril 2022 &nbsp;intitul\u00e9e \u00ab<em> D\u00e9l\u00e9gations au Gouvernement pour le soutien et la valorisation de la famille \u00bb<\/em> a \u00e9t\u00e9 publi\u00e9e au Journal Officiel.<\/p>\n\n\n\n<p>Au cours des 12-24 mois \u00e0 venir, suite \u00e0 cette mesure, une s\u00e9rie de d\u00e9crets l\u00e9gislatifs sera adopt\u00e9e, visant \u00e0 renforcer le \u00ab <em>work life balance \u00bb, <\/em>c\u2019est-\u00e0-dire la conciliation des horaires vie personnelle &#8211; professionnelle et \u00e0 mieux soutenir la famille.<\/p>\n\n\n\n<p>En mati\u00e8re de droit du travail, la r\u00e9glementation des cong\u00e9s parentaux, de maternit\u00e9 et de paternit\u00e9, sera r\u00e9form\u00e9e, selon les lignes directrices suivantes :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>jouissance de la part des parents travailleurs des cong\u00e9s parentaux jusqu\u2019\u00e0 l\u2019\u00e2ge de quatorze ans de l\u2019enfant ;<\/li><li>introduction de modalit\u00e9s flexibles dans la gestion des cong\u00e9s parentaux, de fa\u00e7on compatible avec les formes pr\u00e9vues par la Convention Collective Nationale du Travail du secteur d\u2019appartenance, stipul\u00e9es par les organisations syndicales comparativement les plus repr\u00e9sentatives au niveau national, en tenant compte de la sp\u00e9cificit\u00e9 des familles monoparentales ;<\/li><li>reconnaissance aux parents travailleurs d\u2019un permis r\u00e9tribu\u00e9, d\u2019une dur\u00e9e non inf\u00e9rieure \u00e0 cinq heures au cours de l\u2019ann\u00e9e, pour chaque enfant, consacr\u00e9 aux entretiens avec les enseignants et \u00e0 la participation active au parcours de croissance des enfants ;<\/li><li>reconnaissance au conjoint, au concubin ou \u00e0 un parent jusqu\u2019au deuxi\u00e8me degr\u00e9 de permis pour accompagner la femme aux visites sp\u00e9cialis\u00e9es pendant la grossesse ;<\/li><li>attribution d\u2019une p\u00e9riode minimum, non inf\u00e9rieure \u00e0 deux mois, de cong\u00e9 parental non cessible \u00e0 l\u2019autre parent pour chaque enfant, avec des formes de primes au cas o\u00f9 ces cong\u00e9s seraient distribu\u00e9s de fa\u00e7on \u00e9quitable entre les deux parents ;<\/li><li>attribution au p\u00e8re travailleur d\u2019une p\u00e9riode de cong\u00e9s obligatoires pendant les premiers mois de l\u2019enfant, d\u2019une dur\u00e9e significativement sup\u00e9rieure aux 10 jours d\u00e9j\u00e0 pr\u00e9vus par la loi, \u00e0 demander \u00e0 l\u2019employeur avec un pr\u00e9avis raisonnable.<\/li><\/ul>\n\n\n\n<p>De plus, seront introduites des mesures visant \u00e0 encourager le travail des femmes, au travers :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>d\u2019avantages pour les entreprises, m\u00eame en mati\u00e8re de cotisations, pour les remplacements de travailleuses en maternit\u00e9, pour le retour des femmes au travail, y compris pour leur formation ;<\/li><li>d\u2019une modulation graduelle de la r\u00e9tribution pendant les absences pour maladie des enfants ;<\/li><li>d\u2019aides aux employeurs qui appliquent les clauses de la Convention Collective Nationale du Travail du secteur, portant modalit\u00e9s de travail flexible, avec facult\u00e9 pour les travailleurs de demander, conform\u00e9ment \u00e0 ces conventions, le r\u00e9tablissement du r\u00e9gime contractuel originaire ;<\/li><li>de mesures de soutien \u00e0 la formation en mati\u00e8re financi\u00e8re des femmes chefs d\u2019entreprise et \u00e0 la num\u00e9risation des entreprises.<\/li><\/ul>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La loi d\u2019habilitation n\u00b0 32 du 7 avril 2022 &nbsp;intitul\u00e9e \u00ab D\u00e9l\u00e9gations au Gouvernement pour le soutien et la valorisation de la famille \u00bb a \u00e9t\u00e9 publi\u00e9e au Journal Officiel.
