Tributi Plus Diritto \u2013 Il Sole 24 Ore, 20 mai 2022 \u2013 Enrico De Luca, Alessandra Zilla)"},"content":{"rendered":"\n<p>Par son tout r\u00e9cent jugement n\u00b0 181, publi\u00e9 le 27 avril 2022, rendu dans le cadre de la proc\u00e9dure d\u2019opposition dite \u00ab Proc\u00e9dure Fornero \u00bb, le Tribunal de Vicenza s\u2019est exprim\u00e9 sur la question de savoir s\u2019il convient de tenir compte (ou non), dans la p\u00e9riode de cong\u00e9 maladie, des absences pour maladie li\u00e9es au handicap du travailleur.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Cette affaire fait suite au licenciement signifi\u00e9 \u00e0 une travailleuse handicap\u00e9e pour s\u2019\u00eatre absent\u00e9e pour maladie pendant plus de 365 jours au cours des trois derni\u00e8res ann\u00e9es travaill\u00e9es, d\u00e9passant ainsi la p\u00e9riode de cong\u00e9 pr\u00e9vue par la Convention Collective Nationale du Travail Agidae (Association des G\u00e9rants d\u2019Instituts D\u00e9pendant des Autorit\u00e9s Eccl\u00e9siastiques) de l\u2019assistance sociale applicable au contrat de travail.&nbsp;&nbsp;<\/p>\n\n\n\n<p>La travailleuse, ayant form\u00e9 un recours contre ce licenciement, avait excip\u00e9 la nature discriminatoire pour raisons de handicap et demand\u00e9 au Juge, \u00e0 titre principal, d\u2019en d\u00e9clarer la nullit\u00e9.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>Pour soutenir sa th\u00e8se, la salari\u00e9e invoquait la r\u00e9glementation communautaire en mati\u00e8re de discrimination directe et indirecte (Directive UE 2000\/78\/CE), ainsi que les sentences rendues en la mati\u00e8re par la Cour de Justice Europ\u00e9enne, en soutenant que l\u2019employeur, \u00e9tant tenu d\u2019adopter des \u00ab <em>accommodements raisonnables \u00bb<\/em> afin de \u00ab <em>garantir aux personnes en situation de handicap une pleine \u00e9galit\u00e9 avec les autres salari\u00e9s \u00bb<\/em>, aurait d\u00fb exclure du calcul de la p\u00e9riode de cong\u00e9 maladie les jours d\u2019absence li\u00e9s \u00e0 sa pathologie d\u2019endom\u00e9triose, pour laquelle la salari\u00e9e avait \u00e9t\u00e9 d\u00e9clar\u00e9e handicap\u00e9e, emp\u00eachant ainsi que la p\u00e9riode de cong\u00e9 ne soit d\u00e9pass\u00e9e.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Le Tribunal, confirmant l\u2019ordonnance rendue pendant la phase sommaire, a rejet\u00e9, sur la base de plusieurs arguments, l\u2019opposition form\u00e9e par la salari\u00e9e.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Si \u2013 a pr\u00e9cis\u00e9 le Juge de l\u2019opposition \u2013 il est ind\u00e9niable que la Cour de Justice Europ\u00e9enne a vu une discrimination indirecte au d\u00e9triment du travailleur handicap\u00e9 dans la modalit\u00e9 de calcul des absences pour maladie, dans la mesure o\u00f9 le salari\u00e9 handicap\u00e9 court un risque majeur d\u2019accumuler des jours de maladie, il est tout aussi vrai que les conclusions de la Cour Europ\u00e9enne ne peuvent \u00eatre \u00e9tendues \u00e0 chaque cas de licenciement d\u2019un travailleur handicap\u00e9.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Cela car c\u2019est toujours le Juge national qui doit, d\u2019un c\u00f4t\u00e9, constater si l\u2019employeur a ou non mis en place des solutions raisonnables afin de garantir le respect de la parit\u00e9 de traitement et, de l\u2019autre, v\u00e9rifier le bien-fond\u00e9 de la finalit\u00e9 recherch\u00e9e par la r\u00e9glementation interne.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Quant au premier aspect, au cours de la proc\u00e9dure, le Juge a constat\u00e9 que l\u2019employeur avait mis en place de nombreux \u00ab accommodements raisonnables \u00bb en faveur de la travailleuse, parmi lesquels des visites m\u00e9dicales qui ont constat\u00e9 que la salari\u00e9e \u00e9tait apte \u00e0 exercer ses fonctions sp\u00e9cifiques.&nbsp;&nbsp;<\/p>\n\n\n\n<p>En ce qui concerne le second aspect, le Tribunal s\u2019est exprim\u00e9 \u00e0 propos de la n\u00e9cessit\u00e9 de soupeser les int\u00e9r\u00eats juridiquement pertinents des deux parties, c\u2019est-\u00e0-dire l\u2019int\u00e9r\u00eat du travailleur handicap\u00e9 \u00e0 garder un emploi adapt\u00e9 \u00e0 son \u00e9tat physique et psychique et celui de l\u2019employeur \u00e0 obtenir une prestation de travail utile pour l\u2019entreprise, compte tenu \u00e9galement du fait que l\u2019art. 23 de la Const. interdit les prestations d\u2019assistance, m\u00eame \u00e0 la charge de l\u2019employeur, si elles ne sont pas pr\u00e9vues par la loi\u2026&nbsp;<\/p>\n\n\n\n<p>Continuez \u00e0 lire la version int\u00e9grale publi\u00e9e sur&nbsp;<a href=\"https:\/\/ntplusdiritto.ilsole24ore.com\/art\/legittimo-licenziamento-lavoratore-invalido-superamento-periodo-comporto-AE1WXCaB\"><strong><em>Norme &amp;
