Cela car ce comportement viole les principes de correction et de bonne foi et d\u00e9montre que l\u2019employeur n\u2019avait aucune intention s\u00e9rieuse, effective et concr\u00e8te de ren\u00e9gocier les conditions de la convention collective compl\u00e9mentaire. Il a, selon le Tribunal, port\u00e9 pr\u00e9judice \u00e0 la FILCAMS, qui esp\u00e9rait, avec la r\u00e9ouverture des n\u00e9gociations, pouvoir exercer ses pr\u00e9rogatives. Pr\u00e9rogatives par la suite \u00ab contrari\u00e9es \u00bb par l\u2019inex\u00e9cution de l\u2019employeur qui, lors de la r\u00e9union tenue \u00e0 cette fin, l\u2019avait mise face au choix d\u2019adh\u00e9rer ou non \u00e0 l\u2019accord d\u00e9j\u00e0 conclu avec les autres syndicats.
