Selon les derni\u00e8res orientations de la jurisprudence, la notion d\u2019inexistence du fait contest\u00e9 concerne non seulement les cas o\u00f9 le fait n\u2019est pas mat\u00e9riellement survenu, mais aussi toutes les hypoth\u00e8ses o\u00f9 le fait, mat\u00e9riellement survenu, n\u2019est pas soumis \u00e0 sanction disciplinaire, que l\u2019imputabilit\u00e9 de la conduite du travailleur soit objective ou subjective.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>La l\u00e9gislation de r\u00e9f\u00e9rence et la r\u00e9forme Fornero<\/strong><\/h2>\n\n\n\n<p>Comme on le sait, l\u2019art. 1, alin\u00e9a 42 de la loi 92\/2012 a modifi\u00e9 l\u2019art. 18 du Statut des travailleurs, dans une optique de graduation des sanctions cons\u00e9cutives \u00e0 la d\u00e9cision d\u2019ill\u00e9galit\u00e9 du licenciement, afin que la r\u00e9int\u00e9gration sur le poste de travail devienne&nbsp;<em>le dernier recours<\/em>.<\/p>\n\n\n\n<p>La protection r\u00e9elle, en plus de la nullit\u00e9 du licenciement, est pr\u00e9vue seulement dans les cas d\u2019absence de juste motif pr\u00e9vus aux quatri\u00e8me et septi\u00e8me alin\u00e9as de l\u2019art. 18 du Statut des travailleurs.<\/p>\n\n\n\n<p>Avant l\u2019entr\u00e9e en vigueur de la r\u00e9forme introduite par la Loi Fornero, selon l\u2019art. 18 du Statut des travailleurs, en l\u2019absence d\u2019un juste motif ou d\u2019une faute grave du salari\u00e9, la r\u00e9int\u00e9gration au poste de travail, avec un droit \u00e0 indemnisation variable, \u00e9tait la seule protection dont le travailleur b\u00e9n\u00e9ficiait et, pour statuer sur le caract\u00e8re ill\u00e9gal ou non du licenciement, le juge devait \u00e9valuer si la sanction inflig\u00e9e \u00e9tait proportionn\u00e9e \u00e0 la faute disciplinaire commise par le salari\u00e9.<\/p>\n\n\n\n<p>En substance, avant la r\u00e9forme Fornero, un licenciement pouvait \u00eatre consid\u00e9r\u00e9 comme l\u00e9gal \u00e0 la condition que la r\u00e9siliation du contrat de travail f\u00fbt une cons\u00e9quence proportionn\u00e9e \u00e0 l\u2019inex\u00e9cution du travailleur.<\/p>\n\n\n\n<p>Avec la modification de l\u2019art. 18 du Statut des travailleurs, on introduit le concept de l\u2019inexistence du fait, aussi bien en ce qui concerne le licenciement disciplinaire, o\u00f9 on se r\u00e9f\u00e8re au concept d\u2019 \u00ab inexistence <em>du fait contest\u00e9<\/em> \u00bb, qu\u2019en ce qui concerne le licenciement \u00e9conomique pour lequel on parle d\u2019 \u00ab<em> inexistence manifeste du fait invoqu\u00e9 comme motif du licenciement<\/em> \u00bb.<\/p>\n\n\n\n<p>Le quatri\u00e8me alin\u00e9a traite de l\u2019inexistence du fait contest\u00e9 et du fait faisant partie des conduites punissables par une sanction conservatoire pr\u00e9vue par les conventions collectives ou par le code de discipline.<\/p>\n\n\n\n<p>Le septi\u00e8me alin\u00e9a prend en consid\u00e9ration l\u2019inexistence manifeste du fait invoqu\u00e9 comme motif du licenciement \u00e9conomique.<\/p>\n\n\n\n<p>Continuez \u00e0 lire la version int\u00e9grale sur&nbsp;<a href=\"https:\/\/modulo24contenziosolavoro.ilsole24ore.com\/private\/default.aspx?iddoc=38505003#\/showdoc\/38505003\/fatto|insussistenza|licenziamento?ref=pullsearch\"><em>Modulo24 Contentieux du travail<\/em><\/a>&nbsp;de Il Sole 24 ore.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Le licenciement&nbsp;disciplinaire et la notion d\u2019inexistence du fait contest\u00e9, \u00e0 la lumi\u00e8re de l\u2019\u00e9volution de la jurisprudence, suite \u00e0 la modification de l\u2019art. 18 du Statut des travailleurs, apport\u00e9e par la \u00ab Loi Fornero \u00bb et suite \u00e0 l\u2019entr\u00e9e en vigueur du \u00ab Jobs Act \u00bb.
