{"id":28441,"date":"2022-07-14T10:01:11","date_gmt":"2022-07-14T08:01:11","guid":{"rendered":"https:\/\/www.delucapartners.it\/news\/le-dirigeant-et-limpossibilite-de-renoncer-aux-conges\/"},"modified":"2026-04-07T10:28:45","modified_gmt":"2026-04-07T08:28:45","slug":"le-dirigeant-et-limpossibilite-de-renoncer-aux-conges","status":"publish","type":"post","link":"https:\/\/www.delucapartners.it\/fr\/insights\/le-dirigeant-et-limpossibilite-de-renoncer-aux-conges\/","title":{"rendered":"Le dirigeant et l\u2019impossibilit\u00e9 de renoncer aux cong\u00e9s"},"content":{"rendered":"\n<p>La Cour de cassation, par son arr\u00eat n\u00b0 13063 du 26 avril 2022, a \u00e9nonc\u00e9 le principe selon lequel \u00ab<em> la facult\u00e9 du dirigeant<\/em><em>&nbsp;(\u2026)&nbsp;<\/em><strong><em>d\u2019organiser de mani\u00e8re autonome la jouissance de ses cong\u00e9s<\/em><\/strong><em>, m\u00eame si elle s\u2019accompagne de l\u2019obligation pr\u00e9vue par la n\u00e9gociation collective de communiquer \u00e0 l\u2019employeur la planification de ses p\u00e9riodes d\u2019activit\u00e9 et de repos,&nbsp;<\/em><strong><em>n\u2019entra\u00eene pas la perte du droit, au moment de la rupture du contrat, \u00e0 l\u2019indemnit\u00e9 substitutive des cong\u00e9s si l\u2019employeur ne d\u00e9montre pas, en vertu de ses propres devoirs de surveillance et de direction \u00e0 cet \u00e9gard, avoir formellement invit\u00e9 le travailleur \u00e0 prendre ses cong\u00e9s et avoir par ailleurs garanti que l\u2019organisation du travail et les exigences du service auquel le dirigeant \u00e9tait pr\u00e9pos\u00e9 n\u2019\u00e9taient pas de nature \u00e0 emp\u00eacher qu\u2019il les prenne<\/em><\/strong> \u00bb.<\/p>\n\n\n\n<p>La Cour de cassation s\u2019est ainsi de nouveau prononc\u00e9e sur l\u2019impossibilit\u00e9 de renoncer aux cong\u00e9s. Elle a donn\u00e9 certaines pr\u00e9cisions sur les obligations \u00e0 la charge de l\u2019employeur et sur la charge de la preuve, dans la continuit\u00e9 du principe de droit d\u00e9j\u00e0 affirm\u00e9 dans la sentence n\u00b0 13613\/2020, en le pr\u00e9cisant ult\u00e9rieurement, dans la lign\u00e9e des arr\u00eats de la Cour de Justice Europ\u00e9enne.<\/p>\n\n\n\n<p>En effet, la Cour de cassation a appliqu\u00e9 le principe de droit r\u00e9cemment \u00e9nonc\u00e9, selon lequel, en mati\u00e8re de cong\u00e9s, \u00ab<em> le dirigeant qui, au moment de la rupture du contrat de travail, ne les aurait pas sold\u00e9s, a droit \u00e0 une indemnit\u00e9 substitutive, \u00e0 moins que l\u2019employeur ne d\u00e9montre l\u2019avoir mis en condition d\u2019exercer son droit avant cette rupture, au moyen d\u2019une information appropri\u00e9e et, le cas \u00e9ch\u00e9ant, en l\u2019invitant formellement \u00e0 le faire<\/em> \u00bb (cf. Cass. 2 juillet 2020, n\u00b0 13613).<\/p>\n\n\n\n<p>On sait que, dans le pass\u00e9, une orientation diff\u00e9rente s\u2019\u00e9tait consolid\u00e9e, en vertu de laquelle \u00ab <em>le travailleur ayant qualit\u00e9 de dirigeant et ayant la facult\u00e9 de d\u00e9cider de mani\u00e8re autonome, sans aucune ing\u00e9rence de la part de son employeur, la p\u00e9riode pendant laquelle prendre ses cong\u00e9s, n\u2019a droit, au cas o\u00f9 il ne les aurait pas sold\u00e9s, \u00e0 aucune indemnisation. Cela car, si on ne peut renoncer aux cong\u00e9s pay\u00e9s, le salari\u00e9 qui ne les aurait pas pris de son fait exclusif n\u2019a pas droit \u00e0 une indemnit\u00e9 substitutive, sauf si il d\u00e9montre l\u2019existence d\u2019exigences exceptionnelles et objectives de l\u2019entreprise l\u2019emp\u00eachant de les prendre<\/em> \u00bb (dans le secteur priv\u00e9 voir Cass. 7 juin 2005, n\u00b0&nbsp; 11786 ; Cass. 7 mars 1996, n\u00b0 179 ; dans le secteur public, Cass., Chambres r\u00e9unies, 17 avril 2009, n\u00b0 9146).<\/p>\n\n\n\n<p>Selon la Cour de cassation, le principe \u00e9nonc\u00e9 se fonde sur la position de la jurisprudence communautaire, qui y voit la n\u00e9cessit\u00e9 d\u2019 \u00ab<em> \u00e9viter une situation o\u00f9 la charge de garantir l\u2019exercice effectif du droit aux cong\u00e9s annuels p\u00e8serait enti\u00e8rement sur le travailleur<\/em> \u00bb. En ce sens, il convient que le travailleur soit invit\u00e9 \u00ab<em> si n\u00e9cessaire formellement<\/em> \u00bb \u00e0 solder ses cong\u00e9s et en m\u00eame temps soit inform\u00e9 \u00ab<em> de fa\u00e7on pr\u00e9cise et en temps utile du fait que, si il ne les solde pas, ces cong\u00e9s seront perdus au terme de la p\u00e9riode de r\u00e9f\u00e9rence<\/em> \u00bb.<\/p>\n\n\n\n<p>Enfin, eu \u00e9gard \u00e0 la proc\u00e9dure, la Cour a affirm\u00e9 que la charge de la preuve p\u00e8se sur l\u2019employeur.
