En l\u2019esp\u00e8ce, le v\u00e9hicule conduit par le travailleur, \u00e0 l\u2019arri\u00e8re duquel \u00e9tait plac\u00e9e une grue, a heurt\u00e9, \u00e0 cause du mauvais positionnement cette derni\u00e8re, la poutre d\u2019un pont situ\u00e9 sur la route d\u00e9partementale que le salari\u00e9 parcourait.<\/p>\n\n\n\n<p>La soci\u00e9t\u00e9 avait licenci\u00e9 le travailleur pour juste motif en raison de la grave inex\u00e9cution commise par celui-ci, ayant provoqu\u00e9 l\u2019accident, et en raison \u00e9galement du fait qu\u2019il n\u2019avait pas rempli le disque horaire obligatoire ni le chronotachygraphe attestant la vitesse du v\u00e9hicule.<\/p>\n\n\n\n<p>Au premier et au deuxi\u00e8me degr\u00e9s, le licenciement en question avait \u00e9t\u00e9 d\u00e9clar\u00e9 l\u00e9gitime.<\/p>\n\n\n\n<p>Le travailleur s\u2019\u00e9tait pourvu en cassation contre la d\u00e9cision au fond, avec un seul motif de pourvoi. Selon lui, la Cour d\u2019Appel n\u2019avait pas tenu compte de l\u2019exception soulev\u00e9e selon laquelle d\u2019autres travailleurs ayant commis des inex\u00e9cutions similaires avaient \u00e9t\u00e9 trait\u00e9s de fa\u00e7on diff\u00e9rente.<\/p>\n\n\n\n<p>\u00c0 l\u2019appui de sa th\u00e8se, le requ\u00e9rant invoquait les principes exprim\u00e9s par la Cour de cassation selon lesquels \u00ab<em> bien que, pour d\u00e9terminer l\u2019existence d\u2019une juste cause ou d\u2019un juste motif de licenciement, il importe peu qu\u2019une inex\u00e9cution analogue commise par un autre salari\u00e9 ait \u00e9t\u00e9 trait\u00e9e diff\u00e9remment par l\u2019employeur, au cas o\u00f9 il serait \u00e9tabli que l\u2019inex\u00e9cution du travailleur serait de nature \u00e0 compromettre de fa\u00e7on irr\u00e9m\u00e9diable le lien de confiance, l\u2019identit\u00e9 des situations peut priver la d\u00e9cision de licenciement de sa justification<\/em> \u00bb (cf. Cass. 14251\/2015 ; Cass. n\u00b0 5546\/2010 ; Cass. n\u00b0 10550\/2013).<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>LA D\u00c9CISION DE LA COUR DE CASSATION<\/strong><\/h4>\n\n\n\n<p>Sur ce point, la Cour de Cassation saisie a pr\u00e9cis\u00e9 que les arr\u00eats invoqu\u00e9s par le requ\u00e9rant \u00e0 l\u2019appui de sa th\u00e8se indiquent textuellement que \u00ab<em> Il convient d\u2019approuver l\u2019affirmation selon laquelle on ne peut mettre \u00e0 la charge de l\u2019employeur l\u2019obligation de fournir, pour chaque licenciement, une motivation de sa d\u00e9cision, en la comparant avec les autres mesures prises dans des cas d\u2019esp\u00e8ce analogues (cf. Cass. n\u00b0 5546\/2010). N\u00e9anmoins,&nbsp;<\/em><strong>au cas o\u00f9 la proc\u00e9dure ne ferait pas appara\u00eetre de diff\u00e9rences justifiant une diversit\u00e9 de traitement entre les travailleurs, le juge peut \u00e0 juste titre envisager des solutions diff\u00e9rentes pour des cas identiques, afin d\u2019\u00e9valuer la proportionnalit\u00e9 de la sanction adopt\u00e9e<\/strong> \u00bb.<\/p>\n\n\n\n<p>En cons\u00e9quence, selon la Cour de cassation,&nbsp;<strong>l\u2019\u00e9ventuelle disparit\u00e9 doit appara\u00eetre au cours de la proc\u00e9dure<\/strong>&nbsp;au travers d\u2019\u00e9l\u00e9ments pertinents et ne n\u00e9cessitant pas une reconnaissance contextuelle de la part de l\u2019employeur visant \u00e0 justifier une disparit\u00e9 dans les traitements adopt\u00e9s.<\/p>\n\n\n\n<p>\u00c0 la lumi\u00e8re de ces principes, la Cour de cassation a consid\u00e9r\u00e9 que le motif, tel qu\u2019il avait \u00e9t\u00e9 formul\u00e9 par le travailleur, ne contenait pas les indications n\u00e9cessaires qui auraient d\u00fb \u00eatre d\u00e9j\u00e0 invoqu\u00e9es au cours de la proc\u00e9dure au fond.
